Will of Benjamin CARR of Anne Arundel Co., dated 20 July 1857 LAST WILL AND TESTAMENT OF BENJAMIN CARR JULY 20, 1857
In the name of God Amen. I Benjamin Carr of Anne Arundel County in the State of Maryland being of sound mind, memory and understanding and desirous to settle my worldly affairs, do make, publish and declare the following to be my Last Will and Testament, revoking all others and declaring hereby this to be my Last Will and Testament.
I give, devise and bequeath unto my son Henry Carr the farm wherein he now resides, being the same formerly belonging to my father, the late Robert Carr by paying to my son William, the sum of five thousand dollars when he, the said William arrives at the age of twenty one years, the interest arising from the said five thousand dollars my said son Henry shall apply to the maintenance and education of the said William, his education to be particularly attended to.
I give and bequeath to my son William my negro boy George. My son Benjamin Augustine Carr having derived advantages from my estate which none of the others have, I give and bequeath unto him the sum of two thousand dollars together with my medical library and office furniture.
I give, devise and bequeath unto my sons Marshall, Henry, Arthur Carr and Mortimer Carr all of the balance of my real estate to be equally divided between them by valuation, by paying to each of my daughters Julia, Mary Frances, Rosalie and Alice, the sum of three thousand dollars interest on the above said sum of three thousand dollars not to begin until the day after the division of my personal estate amongst those entitled to received it. The personal property on the real estate devised by my son Henry do not belong to my estate by arrangement with him I have relinquished all of my right thereto.
I give and bequeath unto Marshall, Arthur, Mortimer, Julia, Mary Frances, Rosalie and Alice Carr all of my personal estate of every kind whatsoever, share and share alike in equal proportions but not until after the payments of my debts and legacy and the expenses of the administration which I request be done while disposing of any part of the same when a division of said personal estate to be made between them.
I do hereby constitute and appoint my son Arthur Carr to be my sole Executor of this my Last Will and Testament and my will and desire is that the commissioned allowed for the settlement of my estate shall be equally divided between my Executor and my son Marshall as he will be equally concerned in getting the estate ready for distribution.
In testimony whereof I have hereunto set my hand and affixed my seal, this twentieth day of July, one thousand eight hundred and fifty seven. Benjamin Carr (Seal)
