The Will of Benjamin Titus Green - 8 Feb 1896

I, Benjamin Titus Green, of Mound Bayou Bolivar county of State of Mississippi, now in the City of Vicksburg, being over the age of twenty one years and of sound mind and disposing memory, do make publish and declare this to be my last will and testament, hereby revoking all other wills and testaments. First: I desire that all my just debts and funeral expenses be paid after my death.

Second: I give and bequeath, except two acres and the lot known as Green Square, the two last to be hereinafter explained, my entire undivided half interest in the Eight Hundred acres of land at Mound Bayou, now owned by Montgomery and Green, to my wife, Eva P. Green and my six children equally, viz. Bennie Allen Morris, Mary E., Louise, F., John St. Anthony, Paula Geraldine, Maria Henrietta.

Third: I give and bequeath to my wife the lot known as Green Square above referred to, including my store and dwelling house.

Fourth: I give two acres of cleared land of the Montgomery and Green tract also my mule named Kate to Scott Watson Harrison.

Fifth: I give a mule named Dick and my undivided half interest in the tract of land in said Bolivar County, known as the Kincaid and Francis tract to John W. Francis

Sixth: My five other mules, three horses, three milk cows and their calves, two horse wagons, one log wagon, all notes and accounts due me, as well as my half interest in all notes and accounts due the firm of Montgomery and Green. I give equally to my wife and six children before named.

Seventh: Should I not recover from my illness, it is my desire that my executrix, as speedily as possible, sell my half interest in the saw mill and steam gin now in the Montgomery and Green place and place the duly executed bearing date first day of May AD 1893 giving and bequeathing to Scott Watson Harrison, ten acres of cleared land of the Montgomery and Green tract of land, also my mule named Kate;

Now I, the said Benjamin T. Green, being desirous of altering my said will in respect to said legacy, do therefore make this my present writing which I direct to be amended as a codicil to my said will and taken as a part thereof: I do hereby revoke the said legacies by my will, giving to said Scott Watson Harrison. I do hereby give to the said Scott Watson Harrison the sum of $38.00 with interest at eight per year from May 1st 1885 to date of payment only when he reaches twenty one years of age. And I do ratify and confirm my said will in everything except where the same is hereby revoked and altered as a proceeds in Bank to the credit of the estate.

Eighth:I desire that the estate shall not be divided nor any deed or conveyance made or given to or for any part of said estate till my youngest child becomes of age, should it live. But any of the children attaining their majority and desiring or selecting any special lot on part of said estate, shall be permitted to do so, provided such selection does not exceed said child’s proportionate share of the entire estate and provided said part so selected shall be charged against the part to which said child would be entitled and deducted from his whole undivided fractional interest upon final settlement of the estate.

Ninth: I nominate and appoint my wife Executrix of this my last will and testament and desire that no bounds be required of her; said appointment herewith, to be exclusively upon the condition that she is to sign no bounds nor endorse any commercial paper whatever. Should she do so, then her powers as Executrix shall at once cease and determine and the court shall appoint an administrator to carry out the provisos herein, as fully as my said Executrix may have done.

Whereas I, Benjamin T. Green of Mounds Bayou Bolivar Cty Miss. have by my last will and testament in writing aforesaid.

In witness I hereby set my hands this 13 day of Dec. AD 1893 at Mounds Bayou Bolivar County State of Mississippi. B.T.
