Last Will and Testament of Blanche Shakespear
Blanche (Smith) Shakespear (abt.1860-)
Will Abstract
Blanche Shakespear of Whangaparaoa, Auckland, New Zealand, widow. I appoint my son Robert Hamilton Ross Shakespear and Harold Dixon Buddle of Auckland as excecutors and trustees. All of my property is given to the trustees to set out as follows.
1. To son Robert, all of my stock and farm implements at Whangaparaoa and my boats
2. To my son Robert said farm with the condition that my daughters all have the right to live in the home and use the furniture for their life span or until they marry. One fourth of profits shall be used for upkeep of the home. Upon the death or marriage of the last daughter, Robert shall own the farm completely.
3. If Robert dies before the death or marriage of all of my daughters my trustees may, if they think advisable, continue upkeep of the farm and divide profits giving one half to my son's widow and the remaining one half towards the maintenance of any daughters living in the home. If none of them live there, then half of the profits shall go to the living daughters equally.
4. If the trustees think the above is inadvisable, the farm should be sold and the proceeds divided equally amongst all my daughters and my son's widow. If any of the daughters have died, their issues will be given their share.
5. The remainder of my estate my trustees will hold and apply profits towards the upkeep and maintenance of the houses at "Te Whanga" (the farm) for such daughters as may be living. Upon the marriage or death of the last daughter, my trustees shall divide any residual estate equally amongst all daughters with any deceased daughter's share going to her issues.
6. If the trustees think it advisable to retain the share of my estate and pay unmarried daughters profits, if one of my daughters dies without having received her share, it shall go to her issues listed in her Will, with the rest going equally to my remaining daughters. I also give my trustees authority to:
- a. To invest any money forming my estate as they see fit
- b. To lease, mortgage, or sell any part of my estate needed to upkeep my conditions, as long as upon my son's death the farm shall not be sold without the approval of all of my daughters
- c. To apply the whole, or any part, of the share of my estate of any infant towards his or her maintenance education advancement or benefit, or pay said amount to their guardian, allowing that my trustees are not responsible for any losses.
7. I declare that any personal property or estate given by this Will not impose responsibility for any losses to my trustees. The term "my trustees" shall mean Robert Hamilton Ross Shakespear and Harold Dixon Buddle, and the survivor of them, and the executors and administrators of such survivor, or other appointed trustees that uphold this Will. That any such solicitors may charge my accounts for reasonable and professional amounts. I revoke any prior Wills made by my hand.
