In the name of the Benevolent Father of all I Christian Eby Senior of the County of Preble in the State of Ohio do make and Publish this my last will and Testament in manner and form following to wit Item 1st It is my will that all my just debts and funeral expenses be first fully paid out of my Estate. Item 2nd I give and devise to my beloved wife Susannah Eby all the Household goods and Furniture and I may have at the time of my death. I also hereby give to her one thousand dollars in money which I direct my Executors herein after mentioned to pay to her as soon as the sum can be collected after my death and I also give to my said wife the interest which may accrue on four thousand dollars which sum I hereby direct my said Executors to set apart by [--] and to be loaned out at Interest and the interest so received therein to be paid annually to my said wife during her natural life. And I also give to my said wife during her natural life the Dwelling House which we now occupy together with sufficient House yard and wood shed and well. Also the Garden Grounds now occupied by us. And give and devise to her two head of milch cows which be kept for her as hereinafter directed. I give her also as much firewood from off the farm upon which we now reside as she may need from time to time during her natural life all which I give to my wife in lieu of her dower. Item 3rd I direct that so soon after my death as convenient that my said Executors proceed to sell all my Personal property remaining not herein before bequeathed at Public Sale and I further direct my said Executors to also sell all my Real Estate now owned by me except the Farm upon which I now reside my said Executors to have the privilege to sell any of my Real Estate as aforesaid Either at Public or Private Sale as they may think best the farm upon which I now reside I direct my said Executors to rent out from time to time during the natural life of my said wife upon such terms as they best can however always requiring the tenant to pasture two cows for my wife and furnish stable room for same being that part of the Stable now occupied for cow Stable the tenant also to furnish all feed for her said cows and in the winter time feed them with Hay. After the death of my said wife then my said Executors to sell my Farm upon which I now reside in the Same manner as herein authorized to sell my other Real Estate. Item 4th I hereby direct my said Executors that from time to time as fast as they can convert the residue of my Estate into money that they divide the same equally among my children and Grandchildren as follows, that is to say to my Daughter Elizabeth Coler one Equal full share to my son John Eby one Equal full share To my daughter Jane Harter (Markey) one Equal full share to my GrandDaughters Sarah A Eby and Elisabeth I Haster (daughters of my son Samuel Eby died) one Equal full share to be equally divided between them To my Daughter Susannah Royer one Equal full share To my son Christian Eby one Equal full share. To my Daughter Agnes Engler one Equal full share. To my son Adam Eby one Equal full share. To my son Wilson Eby one Equal full share. To my son James Eby one Equal full share To my Daughter Sarah L Baile one Equal full share and to my son Jacob Eby one Equal share. Item 5th I hereby nominate and appoint my sons Christian Eby and Wilson Eby Executors of this my last Will and Testament hereby authorizing them and Empowering them to compromise a[--ust], release and discharge in such manner as they may deem proper the debts and claims due me. I do also authorize and empower them that whenever they sell any Real Estate as herein before directed Deeds to purchase or Purchasers to Execute Acknowledge and deliver in fee Simple, I hereby give to my said Executors Each the Sum of one hundred and Fifty dollars in lieu of sh[--] fees for settling up my Estate.
