This is a transcript of the will of Francis Butcher, carpenter, of Duckmanton, Derbyshire. His will was dated 14 May 1738 and administration of his estate was granted at Chesterfield on 31 October 1739.

In the name of God Amen I Francis Butcher of Duckmanton
In the county of Darby Carpenter being weake in body but of sound
remembrance praised by God for it I do make & declare this my Last
will and Testament in manor & forme Following first and
princapaly I Recommend my soule into the hands of Almighty God
who gave it in hopes to meet with a Glorious Resorection in and
through the merrits of our Blessed Lord & Savour Jesus Christ
who died for the [sins?] of me and all the world & my body I
commit to the Earth to be decently buried at the discretion of
my Executor heareafter named and as for my temporall
Estate which it hath pleased God to bless me with I give
and dispose thereof as Followeth Imprimus my will is that
all my Just debts & funarall charges be fully paid and discharg[ed]
by my Executor heareafter named Item I give bequath to
my beloved wife Elizabeth Butcher one House & three bayes
of barming & a Gardin & three Closes Lieing & being in the Mannor
of Bonsall & in the county of Darby and in the posetion of
Will Cundy duering her naturall Life shee paying four pounds
a yeare out of them to my daughter Eliz: Bulock for three
yeares nex after my decease & at the end of three years if my wife
so Long Live my will is that the four pounds a year be equaly
divided amonghest my three Sons Tho Butcher & Fran: Butcher & Will Butcher
duering my wifes Life & at my wifes decease I Give & bequaith
to my Son Thomas Butcher one Close in the manno of Bonsall
called Brooke furlong to him for his Life & then to his male heier Lawfully
begotten for ever & for want of such an heier thento his
daughters Lawfully begotten for ever my will is that my son
Tho: Butcher pay to my Grandson John Son of Rob: Butcher
of Ashborn Lately deceased the sume of ten pounds when
he shall come to the age of twenty one yeares but if it

It shall please God that he shall die before he come to
the age of one & twenty yeares then that Ten pounds to be
paid to his two sisters Elizabeth & Catherine Butcher Equaly
when the shall come to the age of twenty one years & for
nonpayment of the Legacy of ten pounds then my will is that
the shall Enter upon the Brook forlong & pay themselves out
of the Rents Item after my wifes decease I Give & Bequaith to my
Son Francis Butcher one House & three bayes of bulding but one
of them is downe & a garding & a close called Casting flat all now
in the mannor of Bonsall & in the posession of Will Conday to
him for his Life & then to his male heirs Lawfully begotten for ever
but for want of such Isshews then to my son Tho: Butcher &
his male heirs for ever Item my will is that my son Francis Butcher
pay to my Grandson John Son of my Son Rob: Butcher Lately
deceased the sume of ten pounds when he shall come at
the age of one & twenty yeares but if it shall hapen that my Grand=
=son die before he come to age then my will is that the ten
Pounds be equaly divided betwixt his two sisters Eliz: &
Catherine Butcher when the come at twenty one years of
age & for nonpayment of the Legacy of ten pounds my
will is that the shall Enter upon the House & Castling flat
& pay themselves out of the Rents
Item after my wifes decease I give & bequaith to my Son
Will: Butcher one Close Lieing in the mannor of Bonsall and
now in the possetion of Will Cundy K[n]own by the mane
of Rie Close to him for his Life & then to his male Heir Lawfully
begotten for ever my will is that Will Butcher pay to my
Grandson John Butcher son of Fran Butcher the sume of

ten pounds when he shall come to the age of one and
twenty yeares but if it shall please God that he die before he
come to Age then that Legacy of ten pounds to be paid to his
next brother then Alive & for nonpayment of the ten pounds
my will is that the shall Enter upon the Rie Close & pay them
selves out of the Rents; all these Legacyes are to be paid of
Currant moneys of Great Brittan and as for my personal
Estate my will is that my wife shall have the best bed &
a chest of drawers & what table Linin she thinks fit and as
my Executor and her can Agree on; Item I give to my
Son Will: Butcher my House Clock & to my son Francis
Butcher all my weareing Clothes I give to my son Thomas
Butcher my pockit watch and as for Reste of my personal
Estate my will is that it be valued and after my Juste debts
and funarall Charges be paid and discharged
my will is that the Remaining parte of it be divided into
five Equall partes my son Fran: Will & Elizabeth Bullock
to have three of them & the other two my son Tho to have
and as for my Lead mynes my will is that the be Equaly divided
amongst Tho: Fran & WIll Butcher & my daughter Elizabeth
Bullock all the Rest of my bookedebtes bonds posetions bills
& whatever I am posesed of I give to my son Tho: Butcher
and I do also nominate constitue & Apoint my son Thomas
Butcher Sole Executor of this my Last will & testament Revo=
keing all other wills hearetofore made by me In witness
hearof I have hearunto set my hand and seale this
Forrtenth day of May Anno: domini one thousand seven
hundred thirty Eight signed sealed published & declared

and so forth.
Which day and place Lowe appeared and exhibited a special Proxy under the
hand and Seal of Thomas Butcher sole Executor named in the last Will and
Testament of Francis Butcher late of Sutton Duckmanton in the County of
Derby and Diocese of Lichfield and Coventry deceased and made himself party
For him and alledged that the said deceased whilst having made his Will in
writing and therein named his Client sole Executor, but for diverse good
Considerations him thereunto moving hath renounced all his Right to the
Execution of the said Will Whereupon Francis Butcher natural & lawful
son of the said deceased appeared personally and alledged himself to be one
of the Residuary Legatees named in the said Will and by reason of the said
Renunciation entitled to the Administration of the said deceased’s effects
and prayed the same to be granted to him with the said deced’s Will annexed
which the Surrogate at his petition accordingly decreed
He being first duly sworn before me
