Will of Garland Anderson[1]
I Garland Anderson being in my usual health and mind and recollecting that is appointed for all men to die and the great uncertainty of life do make this my last will and testament.
Touching my worldly affairs I desire and direct that my funeral expenses and debts if any should be paid out of the proceeds of the sales of my personal estate.
Secondly, I will unto my wife, Sally Anderson, the use of the land containing about four hundred and eighty one acres to be hers until my son Robert arrives to the age of 21 years at which period the said lands to be equally divided between them by a line running from the Caney fork north... to the back line including the mansion house, yard and garden in the lower half or half ??? to Madjor Haskins which is to be my said wifes durning her life. I also wwill unto my said wife three head of horses, six head of catte, ten of sheep, twenty of hogs to be of an average value out of my said stock. I also will to my said wife Sally one hundred and fifty dollars worth of my household and kitchen furniture and farming utensils to be her and her heirs forever. I also will unto my said wife durning her life the following negroes, namely, Franny, Silvey, Billy, Sam, Flemming, Mehaly, Judy, Esther, Randal and Robbin out of all which estate she is to raise support and school my children Martha and Eliza and at the death of my said wife I will that the forenamed negros with their increase belong to my said children, Martha and Eliza to them and their heirs forever. But if my said wife should not accept this provision and choose to take her thirds in my estate, then and in that case I will to my children by her nothing at all and that said dower estate descend to my children by my last previous wife.
Thirdly, having personally given to my son Alfred what I intended for him out of my estate and having this day given to my son Peter the negroes and other property I intended for him, nothing more is devised to them. To Franklin Anderson I will a negro man named Armstead in addition to what I had previously given him. I will and devise to my daughter Ellen Anderson the following negroes, to wit, Bess, Maltida, Eliza, Fanny, George, Willis, and Caty together with their future increase to her and her heirs forever. The intent of this devise is that the use of said negroes is to belong to said Ellen and that the porperty in them descend to her heirs.
I will and devise to my son Robert Anderson the lands and plantation on which I now live supposed to contain four hundred and eighty one acres to him and his heirs forever to possess the one half of said land when he arrives at the age of 21 years and the balance on the death of my said wife Sally Anderson. I also will unto him my said son the following negroes, to wit, James, John, Mamie, Shelton and Garret together with all their increase to him and his heirs forever.
I will unto my daughter Mary O Allen all my personal estate not heretofore disposed of to be vested in ?? money and retained by my executors and laid out by them in a way (use their judgement) best calculated for her support and comfort through life and if any of said deviise should be remaining at her death I will it belong to here issue if she has any, if none to belong and be equally divided between my sons, Franklin, Peter and Robert Anderson and my daughter Ellen or the survivors of them.
It is also my will that if either of my children die without issue their estate belong to my second wife's children namely Franklin, Peter, Robert, Ellen and Mary or the survivors of them.
Lastly I hereby appoint my friend John Barret and my son Peter Anderson executors of this my last will and guardians to my infant children with directions that no security should be required of said Barret for his performance as such I also revoke all wills heretofore made.
In testimony of all which I have herewith set my hand and seal this 4th day of June 1829.

At a county court held for Green County at the courthouse in Greensburgh on the 21th day of September 1829: The within last will and testament of Garland Anderson, deceased was produced in court by the executors therein named and proven by the oath of Robert Stockton and A W Hillard two of the subscribing witnesses which to have been signed sealed and published by the said decedent as his last will and testament and at the time of executing the same they believe him to be in his perfect mind and memory and the same was ordered to be recorded which is don accordingly.
