Joint Will and Last Testament of Joseph and Hannah Silvester[1]
- Note: the following is a full and accurate transcription of the joint will and last testament of Joseph Sylvester II (1664-bef.1754) and Hannah (Bartlett) Sylvester (abt.1665-bef.1754).
In the Name of God Amen the first day of November, In the year of our Lord, One thousand Seven Hundred and Thirty and four—————
We Joseph Silvester and Hannah Silvester his wife both of Plimouth in the County of Plimouth In his Majesty's province of the Massachusets bay in New England; Calling Unto mind the Mortality of our bodys, and knowing That it is appointed for all men Once to dye; Do Make and Ordain this our last Will and Testament, That is to say Principally and first of all, We Give our Soles into the hands of God yt Gave then & Our Bodys We Recommend to the Earth to be Buried in Decent and Christain manner at the Discretion of our Execrs.
Nothing Doubting but at the Generall Resurrection We shall Receive the same aGain by the Allmightly power of God and as Touching such worldly Estate. Wherewith it hath pleased God to Bless us in this Life, We Give & Demise & Dispose of the same in the following Manner and form———
Imprimis; We Give to our well beloved son Sollomon Silvester Forty acres of land of the southerly side of our Land which Lieth at the head of the Mill pond in Plimouth at Moniment ponds, to him his heirs and assigns for Ever; togather with what he hath allready Reserved is his full part of our Estate—
Item, We give to the Children of our son Joseph Silvester Deceas•d, One fifth part of all our Estate both Real and personall in Plimouth and Else. to them there heirs and Assigns forever,
Item We Give to our four Daughters, Hannah Holmes, Mary Rider, Thankfull Rider and Content Holmes four fifths of all our Estate both Real and personall in Plimouth and Else where. To them there heirs and assigns for Ever. to Each of them in Equall parts that is Each of them one fifth part of all our Estate and if it so happen that the above named Hannah Silvester after the Decease of her Husband she shall have the Improvement of the above Demises premisses and all the whole of Estate Dureing her Naturall Life and after her Decease to be Inherited in Manner, as above Expresed
We Do also Hereby Constitute our Well beloved sons, Solomon Silvester and Eleazer Holmes our Sole Execrs of this our last Will and Testam.t and We do Hereby Utterly Disalow revoke and Disanull all and every other former Testam.t, Will, Legaices & Bequests [?] Exect by us in any ways before named willed and Bequeathed. Ratifying and Confirming this and no Other to be our last Will and Testamt.

Plymouth Sc March 4.th 1754. This Will being Exhibited for probate by the Executors therein named for said Elisha Holmes made Oath that he saw the said Joseph Silvester and Hannah Silvester the Testators, Sign and Seal and publish this Instrument to be their Last Will and Testm.t and that he Togather with the said Josiah Morton and Elisha Holmes Jun.r (who is since Deceas.d) Subscribed as Witnesses in the Testators presents, and that according to his best Judgent, they were then of sound Mind——
Before Me John Cushing Judge of probt.
Province of the Massachusets Bay Plimouth Sc Bay the Honble John Cushing Esqr. Judge of the prob.t of Wills, and for Granting Letters of Adm.n of the Estates of persons Deceas.d haveing Goods Chattles Rights or Credits in the County of Plimouth within the province aforesaid
To All unto Whome These presents shall Come, Greeting
Know Ye, that upon the Day of the Date Hereof before Plimouth in the County aforesaid the Will of Joseph Silvester and Hannah his wife, late of said Plimouth Deseas.d to these presents Annex.d, was proved approved and allow.d who haveing while they Lived and at the Time of there Death Goods Chattles Rights or Credits in the County aforesaid and the probate of the said Will and power of Committing Administration of all and singular the Goods Chattles, rights of the said Deceas.d by Vertue thereof appertaining Unto me the Adm.n of all and Singular the Goods Chattles rights and Credits of the said Deceas.d and their will in any manner Concerning, is Hereby Committed unto Solomon Silvester and Eleazer Holmes, both of said Plimouth Executors in the same will named well and faithfull to Execute the said Will, and to Adm.r the Estate of the said Deceas.d According thereunto, and to Make atrue and perfict Inventory of All and Singular the Goods, Chattles, Rights and Credits of the said Deceased, and to Exhibite the Same into the Registry of the Coury of prob.t for the County of Plimouth at or before the fourth Day of June next Ensuring and also to Render aplain and True account of there said Adm.n Upon Oath within twelve month next Coming.
In Testimony Whereof I have hereunto Sett my Hand and the seal of the said Court of Prob.t
