Will of Harriet (Hackney) Bailey
This is the last Will and testament of me Harriet Bailey of
Congleton in the county of Chester Widow In the first place I direct all my
just debts and funeral and testamentary expenses to be paid and subject
thereto I give and devise all my real and personal estate whatsoever
and wheresoever unto my friends James Webb of Congleton aforesaid Grocer
and Samuel Lea of Somerford Booths in the said County of Chester
Brickseller their heirs executors and assignees upon trust at such times
after my decease as and when in their discretion shall seem best to sell call
in and convert in to money such portions of my estate as shall not consist
of money and to stand prospect of the entire proceeds of my estate upon
trust to divide the same into two equal half parts or moieties and out
of one such half part or moiety to pay John Bailey Hassall the
son of my late husbands Sister Mary Hassall a legacy or sum of
twenty pounds but in case he shall not be living at the time of my death
such legacy or sum of twenty pounds to fall back into and form part of the
moiety now being disposed of and to divide the remainder of such half
part or moiety after deducting such sum of twenty pounds or including it
if such legacy shall have lapsed as aforesaid unto and equally between and
amongst such of the children of my late husbands brother William Bailey
viz Daniel, Joseph, James, Rachel, william and john and the children
of my late husbands sister Sarah Orme viz Daniel, George, Sarah,
Harriet, Edward, Herbert, Thomas and Elizabeth as may be living at my
death and the children or child of such of them my said husbands nephews
and nieces as may at the date of the execution of this my Will be already
dead or as shall hereafter die during my lifetime leaving any children or
child who shall be living at the time of my decease such children or child
nevertheless to stand in the place of and take amongst them in equal shares
if more than one and such share only as their deceased parent would have
taken if living at the time of my death And upon trust as to the other
moiety of the proceeds of my estate to pay thereout the sum of twenty
pounds to Alice Barbrook a child of my Great Nephew Thomas
Barbrook if living at my decease but if dead such sum to fall into the
moiety now being disposed of and divide the remainder thereof (and including
the said sum of twenty pounds if lapsed) equally between and amongst
such of the children of my late sister Ellen viz John, Harriet, Samuel,
Lot, Job and Ellen and the children of my sister Hannah Davenport viz
Joel, Allen, Henry, Martha, Maria, Emma and Charles as may be
living at my decease and the children or child of such of them my said
nephews and nieces as may at the date of the execution of this my Will be
already dead or as shall hereafter die during my lifetime leaving any
children or child who shall be living at the time of my decease such
children or child nevertheless to stand in the place of and take amongst
them in equal shares if more than one and such share only as their deceased
parent would have taken if living at the time of my decease And I
empower my said trustees to invest any monies in their hands on paid
securities in England or the bonds or debentures or debentures stock of any
public Company incorporated by Act of Parliament or the Post Office or
National Savings Bank as well as on any other securities authorised
by law for investment by Trustees And I give and devise such estates
as may be vested in me as trustee or mortgaged to the said James
Webb and Samuel Lea their heirs executors and administrators according
to the next use and quality thereof upon the trusts and subject to the
equities affecting the same And I appoint the said James Webb and
Samuel Lea Executors of this my will I witness whereof I have hereunto
set my hand this twenty sixth day of march one thousand eight hundred
and eighty one - Harriet Bailey - Signed and acknowledged by the
said testatrix as her last Will in the presence of us present at the same time
who at her request in her presence and in the presence of each other have
hereunto subscribed our names as witnesses - Henry L. Reade Sol: Congleton

This is a Codicil to the above Will of me Harriet Bailey my
friend Samuel Lea whom I have appointed trustee and executor of my
said Will having died since the execution thereof I do hereby appoint
my nephews Allen Davenport of Arclid Shoemaker and John Bailey of
Lower Peover Farmer trustees and executors these along with the said James Webb
And I do hereby give and devise all my real and personal estate whatsoever
unto them the said James Webb, Allen Davenport and John Bailey their
heirs executors administrators and assignees upon such and the same such as
are declared of and concerning the same in my said Will as fully as if the
said Allan davenport and John Bailey had been named in my said Will
as ?devised in trust and Executors along with the said James Webb and
Samuel Lea And in all other respects I confirm my said Will in Witness
whereof I have hereunto set my hand this twelfth day of October one thousand
one hundred and eighty two - Harriet Bailey - Signed
and acknowledged by the said testatrix as a codicil to her last will in the
presence of us present at the same time who at her request in her presence
and in the presence of each other have hereunto subscribed our names as
witnesses - Henry L Reade Sol: Congleton and James Foden his clerk
- Proved at Chester with a codicil the 20th day of February 1884 by
- the oaths of Allen (in the codicil written Allan) davenport and
- John Bailey the nephews the Executors named in the codicil to
- whom Administration was granted Power reserved of making the like
- Grant to James webb the executor named in the will
The Testatrix Harriet Bailey was late of Congleton in the County of
Chester Widow and died on the 31st day of December 1883 at Congleton
aforesaid
