Will of Henry Holbrook (bef.1721-bef.1805)
This is a transcription of the register copy of the Will of Henry Holbrook, Mariner of Deal, Kent. It was written on 27 January 1803 [1] and proved at London on 31 January 1805.[2]

This is the last Will
and testament of me Henry Holbrook of this Town
and Borough of Deal in the County of Kent Mariner
made this twenty seven day of January in the year
of our Lord one thousand eight hundred and three

first I give and bequeath all and singular my
wearing apparel of every description as follows (that
is to say) one full equal moiety or half part ~
thereof unto my Son Isaac Holbrook and the other or
remaining moiety or half part thereof unto and ~
equally between all and every the child and children
of my late Son John Holbrook deceased herein after

particularly named? share and share alike and I
give devise and bequeath all and singular my
freehold and Leasehold Messuages Lands Tenements
and Heredits and parts purparts and shares of and
in any freehold and Leasehold Messuages Lands =
Tenements and Heredits whatsoever and wheresoever
whether in possession Reversion Remainder or =
Expectancy and also all and singular my Goods
Chattels Effects debts due and owing to me Money
Securities for Money Money in any of the public
Stocks or Funds of this Kingdom and all other my
Personal Estate whatsoever and wheresoever and of
what kind or nature soever rhe same may be at
the time of my decease (except my said wearing
apparel) unto my two friends Thomas Woodruff
of Deal aforesaid carpenter and Samuel Hadley of
Deal aforesaid Baker and to their Heirs Executors
and Advisors according to the nature of the said
Estates respectively upon this special Trust and
confidence nevertheless in them reposed and to the
Ends Intents and purposes following (that is to say)
upon Trust that they the said Thomas Woodruff and
Samuel Hadley and the Survivors of them his Heirs
Executors and Advisors according to the nature of
the said respectve Estates shall and do with all =
convenient speed after my decease sell convey =
assign and dispose of all and singular my said
Freehold and Leasehold Estate and Estates either
altogether or in parcels and either by public =
Auction or private confront? and in such manner
and form – as to them shall seem advisable =
unto any person or persons that shall be willing
to purchase the same and also sell and dispose
of collect get in receive? and convert into ready
Money all my said personal Estates and Effects at?
(except as aforesaid / and for the promoting and
facilitating of such Sale or Sales as I have before
directed to be made of my said Freehold and =
Leasehold Estates my Will and meaning is and I
so hereby order direct and declare that the =
purchaser or purchasers thereof shall not be =
.... to see the purchase Money with him
her or them respectively confronted? for paid and
applied according to the directions of this my will
but that the Receipt or Receipts of my said Trustees
or of the Survivor of them or of the Heirs Executors
or Advisors of such Survivor shall effectivally = =
discharge the respective purchasor or purchasers and
his her or their Heirs Executors Advisors and Assigns
from so .... Money as in such Receipt or Receipts shall be
acknowledged or expressed to be received and that
after such receipt or receipts the purchasor or =

purchasers his her or their Heirs Executors Advisors and
Assigns shall not be obliged to see the Monies by
them paid respectively applied in pursuance of this
my will or be answerable or accountable for any
Loss misapplication or nonapplication of such =
purchase Money or any part thereof and as to all
the Money which shall arise by the Sale or Sales
of my said Freehold and Leasehold Estates or of
any part thereof or by the Rents and profits thereof
till such Sale or Sales shall be made and by the
produce of my said personal Estate my will and
meaning is and I do herein expressly order and
direct that my said Trustees and the Survivor of
them his Executors and Advisors do and shall stand?
possessed? of the same upon the following trusts (that
is to say) upon Trust after payment of all my
just debts Funeral Expenses and the charges of
proving and executing this my will and reserving
to themselves the said Thomas Woodruff and Samuel
Hadley the Sum of Five pounds apiece of lawful
Money of the United Kingdom of Great Britain and
Ireland as used in England which I do hereby =
give and bequeath to them as an acknowledgement
for the care and Trouble they will have in =
proving and executing this my will and the Trusts
hereby created that they my paid Trustees and the
Survivor of them his Executors and Advisors do and
shall pay the Sum of Twenty pounds apiece of =
lawful Money of the United Kingdom of Great =
Britain and Ireland as used in England part thereof
unto my Grand children Charles, John William =
Thomas, James, Ann Susannah, Frances, Randall =
George and Sarah Holbrook children of my said
late Son John Holbrook deceased the Sum of Twenty
pounds apiece of like lawful Money further part
thereof unto my Grand Children Jane, Hannah, =
Henry Humphrey and Mary Joy Holbrook children
of my said son Isaac Holbrook the sum of Twenty
pounds apiece of like lawful Money further part =
thereof unto my Grand Children Mary Hayward =
(the wife of James Hayward of Deal aforesaid Stay
Maker) and Ann Holbrook daughters of my late Son
William Holbrook deceased and the Sum of Seven =
pounds – and tens hillings of like lawful Money =
further part thereof unto my Housekeeper Mary =
Thomas and as to all the rest and residue of the =
Money arising by the Sale Rents Profits and produce
of my said Freehold Leasehold and personal Estates =
and Effects after such payments as aforesaid upon =
trust that they my said Trustees and the Survivor of –
them his Executors or Advisors shall and do stand = = =
possessed of the same upon to and for the several =

Trusts Intents and purposes hereinafter mentioned
and declared of and concerning the same (that is to
say) upon trust to pay one full fifth part thereof =
unto my said Son Isaac Holbrook one other full fifth
part thereof unto my Grand Daughter Elizabeth =
Durban wife of William Campbell(*) Durban of Deal
aforesaid Mariner as to one other full fifth part
thereof upon trust to pay the same unto and equally
between and amongst all and every the said children
of my said late Son John Holbrook deceased share
and share alike to such of them as shall be of
the age of one and twenty years being a Son or
Sons or of the age of one and twenty years or
married being a daughter or daughters at the time
of my decease as soon as conveniently may be
after my decease and to such of them as shall be
under that age of one and twenty year being a =
Son or Sons or under that age and unmarried
being a daughter or daughters at the time of =
my decease when and as they shall respectively
attain the said age of one and twenty years =
being a Son or Sons or the age of one and = =
twenty years or be married which shall first
happen being a daughter or daughters and I direct
that the part and share or parts and shares of
such Child or Children being under age as to =
Sons and under age and unmarried as to = =
daughters shall be by my said Trustees and the
Survivor of them, his Executors or Advisors in the
mean time placed out at Interest in some one or
more of the public Stocks or Funds of this Kingdom
or upon some good private Security or Securities
as to them shall seem meet and that they my said
Trustees and the Survivor of them his Executors or
Advisors do and shall pay apply and dispose of the
Dividends Interest and Annual produce thereof as =
and when the same shall arise and be received
for and towards the Maintenance Education and
bringing up of such Children respectively till ?
their respective parts and shares become payable
by this my will and in case my said Trustees or
the Survivor of them his Executors or Advisors
shall see it necessary and think it proper and
meet I do hereby authorize and empower them
or him to pay apply and dispose of the whole
or any part or any part of the original part
or share or parts and shares of such Child or = =
Children under age being a Son or Sons and
under age and unmarried being a daughter or
daughters for or towards their better Maintenance
Education bringing up or preferment in the =
world during their respective minorities? so that
no one of such Children shall have and receive

one other full fifth part thereof upon trust to put and place
out the same at Interest in some one or more of the =
public Stocks or Funds of this Kingdom or upon some

pay the Interest thereof unto Elizabeth Fells wife of
Thomas Fells of Deal aforesaid cordwainer late widow
of my said late Son William Holbrook deceased or
otherwise permit and suffer her to receive the same

from and immediately after her decease to pay =
assign and transfer the said last mentioned fifth part
and the Stocks Funds or other Securities in or upon
which the same or any part thereof shall be = =
invested or secured? or the Money to arise by Sale =
thereof unto and euqally between my said two = = =
Grand Daughters Mary Hayward and Ann Holbrook =
daughters of my said late Son William Holbrook = =
deceased share and share alike and as to the = = =

Kimgdom or upon some good private Security or =
Securities either Real or personal and after vary and
change the same from time to time as occasione shall
be or require and pay the Interest thereof unto Jane
Holbrook widow of my late Son Henry Holbrook = =
deceased or otherwise permit and suffer her to receive
the same for and during the term of her natural
life and from and after her decease to pay assign
and transfer the said last mentioned fifth part and
the Stocks Funds or other Securities in or upon which
the same or any part thereof shall be invested or
secured or the Money to arise by Sale thereof as =
follows (that is to say) one full fourth part thereof =
unto my said Son Isaac Holbrook or to his = =
Executors or Advisors if he shall be then dead one
other full fourth part thereof unto ^ and amongst all

the said Thomas Woodruff and Samuel Hadley = =
Executors of this my last Will and Testament and I
will and direct that my said Trustees and the =
Survivor of them his Heirs Executors or Advisors =
shall not be answerable or accountable for any =
more of the said Trust Estates Monies and premises/provisions?
than they respectively shall annually receive or shall
come to their respective hands by virtue of this my
will nor with or for any loss which shall happen
of the same or any part thereof so as such loss
happen without their or his willful defaults? or =
default? nor the one of them for the other of them
or for the Acts Deeds Receipts Disbursements or = =
defaults? of the other of them but each of them for
his own Acts Deeds Receipts Disbursements and = =
defaults only and also that it shall and may be =
lawful for them my said Trustees and the = =
Survivor of thems his Executors and Advisors in the
first place by and out of the said Trust Estates =
Moneis and premises to deduct? and reimburse =
themselves respectively all such Losses Costs Charges
and Expenses as they respectively shall actually =
expend or be put unto suffer or sustain for or
by reason of the Trust hereby in them reposed?
or the Management and execution thereof or in
any thing relating thereto and lastly I revoke all
former wills by me made In witness whereof I
the said Henry Holbrook the Testator have to this
my last Will and Testament contained in four
Sheets of paper annexed together to the first three

Knight Doctor of Laws Master Keeper or Commissary

by the Oaths of Thomas Woodruff and Samuel Hadley
the Executors named in the said will to whom =
Adm[ministrati]on was granted of all and singular the Goods
