Transcript of will of Herbert Stocker
This is the last will and testament of me Herbert Stockhore of the parish of Clewer in the county of Berks. Labourer which I make as follows first I direct my executors herein after named to pay and satisfy all my just debts and funeral and testamentary expenses as soon as conveniently may be after my decease I give and bequeath unto my wife Sarah Stockhore all that my piece or parcel of land situate and being near Clewer Lane in the Parish of Clewer aforesaid containing about one acre and thirty perches which I hold under lease from Arthur Vansittart Esquire together with the Eleven Cottages or tenements and washhouse erected and built by me thereon or some part or parts thereof with all appurtenances to the said premises to hold the same to my said wife and her assigns for and during such part of the term estate and interest which I shall have therein at the time of my decease and she shall happen to live and after the decease of my said wife Then as to the two cottages or tenements now in the occupation of my son Ezekia Sampson Stockhore and _____ Collier together with fifty poles of the said land adjoining the said cottages with their appurtenances I give and bequeath the same unto my said son Ezekia Sampson Stockhore and his assigns for and during all the residue of the term of years which shall be unexpired therein at the time of my said wifes decease provided my said son shall so long live free from all ground rent But in case of his death before the determination of my estate and interest therein I give and bequeath the said two cottages or tenements and fifty poles of land with the appurtenances unto all and every child and children lawfully begotten of my said son Ezekiah Sampson share and share alike as tenants in common and to the executors and administrators and assigns of such child and children respectively for the residue of the said term then unexpired therein and as to the five cottages or tenements now in the occupations of myself William Mendy[?] James Mackenzie Luke Bowling and William Gilbert together with one moity of the said land (which shall remain over and above what I have herein before bequeathed to my said son Ezekiah Sampson) with their appurtenances I give and bequeath the same unto my son Shakespeare Pinder Stockhore and his assigns for and during the residue of the term of years which shall be unexpired thereon at the time of my said wife's decease provided my said son shall so long live but in the case of his death before the determination of my estate and interest therein I give and bequeath the said five cottages or tenements and moity of land aforesaid with the appurtenances unto all and every the child and children lawfully begotten of my said son Shakespeare Pinder share and share alike as tenants in common and to the executors adm[inistrator]s and assigns of such child and children respectively for the residue of the said term then unexpired therein and as to the four remaining cottages or tenements in the respective occupations of John Moulls[?] William Clark my daughter Venus Britannia Hearn and James Titcombe with the washhouse thereto adjoining together with the other remaining moity of the said Land with their appurtenances I give and bequeath the same unto Charles Snowden of New Windsor in the county of Berks grocer and Charles Hewitt of the same place grocer their executors and administrators during all the residue of the term of years which shall be unexpired at the time of my said wifes decease provided my said daughter shall so long live upon trust that they the said Trustees or the survivor of them his executors or administrators shall pay the rents and profits of the said last mentioned premises unto my said daughter Venus Britannia Hearn during her natural life for her sole use and benefit and her receipts alone (notwithstanding her reverture) shall be good discharges for the same and I declare that the same shall not be subject to the debts or control of her present or any future husband and in case of the death of my said daughter before the determination of my estate and interest therein then In trust for and I give and bequeath the said four cottages or tenements washhouse and moity of land last mentioned with their appurtenances unto all and every child or children lawfully begotten of my said daughter share and share alike as tenants in common and to the executors administrators and assigns of such child and children respectively for the residue of the said term then unexpired therein And it is my will & desire that the yearly rent of eight pounds reserved by my said lease to the said Mr Arthur Vansittart for the whole of the said premises shall be paid and payable out of and charged upon the several cottages or tenements land and premises so by me bequeathed to my said daughter and son Shakespear Pinder during the remainder of the term which at my said wife's death shall be to come in the said premises so and in such manner that the cottages and premises bequeathed to my said son Ezekia Sampson shall be enjoyed by him and his children discharged from the said rent or any part thereof and all liability in respect thereof provided and my will is that in case either of my said children shall depart this life without leaving lawful issue then I bequeath the share or shares to which such issue (if any) would have become intitled to under this my will unto the survivors or survivor of my said children if more than one share and share alike their his or her executors administrators and assigns provided and it is my further will and desire that neither of my said children do or shall sell or mortgage his or her life interest in the said premises heretofore bequeathed to or for them and their issue respectively as aforesaid on pain of forfeiting his or her estate and interest therein And as to all my household goods and furniture and the residue of my personal estate of every description I bequeath the same unto my said wife her executors administrators and assigns and I hereby appoint the said Charles Snowden Charles Hewitt and my said wife Executors and Executrix of this my will and I revoke all wills and codicils by me heretofore made and declare this to be my last will and I also declare that my said Trustees and Executors shall not be answerable the one for the other or for involuntary losses but accountable for himself and herself only and that they and each of them may reimburse themselves respectively all their reasonable costs and expenses attending the execution of this my will out of any monies which shall come to their his or her hands In witness whereof I have hereunto set my Hand and Seal this twenty sixth day of January in the year of our lord one thousand eight hundred and thirty two. Proved at London 1st May 1834 before the Worshipful John Danbury Dr of Laws and Surrogate by the oath of Charles Snowdon one of the executors to whom admon was granted having been sworn duly to Administer Power reserved of making the life grant to Charles Hewitt and Sarah Stockhore Widow the relict the other executors.
