This is a transcription of the register copy of the will of John Collins a brewer of Worcester. John drew up his will on 23 September 1633 and it was proved at the Prerogative Court of Canterbury on 6 December 1634. The register copy is followed by a lengthy "Lecta Lata et Promulgata" ("Read, Enacted and Promulgated") in Latin which shows that the will was disputed. [1]

Of note:

  • The testator was one of two brothers named John
  • Testator did not name or mention a wife.
  • The Testator mentioned two men named Hackett (Thomas and Henry) as brother in laws. His unnamed wife was probably a Hackett.
  • The testator mentioned a friend Mr George Streete and his wife Elizabeth, in the adjoining sentences mentioning brother in law Thomas Hackett and George Brooke. At the end of the will Testator states that if Henry Hackett dies, "the said Mr John Streete, Thomas Hacket and George Brooke" will be replacement guardians. There is no John Streete mentioned before in the will.

the three and twentith daye of September Anno Domin[i] Millesimo Sexcentesimo
Tricesimo Tertio I John: Collins of the Cittie of Worcester brewer, weake and sicke in
bodye yet of good and p[er]fect memorye (thanks be given unto Almightie god) Doe make
my testament and last will in manner and forme followinge First and principally I comend
my soule into the hands of Almighty god and my body to the earth whereof it is formed Touching
that worldly estate wherewith it hath pleased god to endowe me I give devise and bequeath the
same as followeth

Imprimis I give and bequeath unto my three brothers vizt John Collins, William
Collins and Thomas Collins To each and every one of them Twentie pounds a peece of lawfull
money of England To be payd unto each and every one of them w[i]thin Sixe monethes nexte
after my decease

Item I give and bequeath unto my granndchild Thomas Streete the some of One
hundred pounds of like money of England w[hi]ch my will is and soe I doe appointe shalbe payd unto
his father Thomas Streete w[i]thin sixe monethes next after my decease and by him forthw[i]th after
receipt thereof put out for the best benefitt of my said grandchild and the said hundred pounds w[hi]ch
the forbearance and profitt soe thereby raysed and made duely payd unto my said granndchild att his
age of twenty one yeares Provided and my Will is and soe I doe devise and appoynte that if my said
granndchilde shall decease this lief before he shall have accomplished his full age of Twentie one yeares
then my saud guift and bequest of One hundred pounds given unto him as aforesaid w[i]th the forbearance
and profitt thereof raysed and made shalbee remayne and come unto such other Child or Children as
my daughter Streete shall then have liveinge betweene her husband Thomas Streete and hir equally
and porc[i]on and porc[i]on like payd unto them (att the tyme the same should have benne due unto my granndchild
Thomas if he had benne liveinge by the saide Thomas Streete their father his executors or administrators
And my Will is that my Sonne in lawe Thomas Streete doe secure the payinge of the said hundred pounds
unto his child or children by indifferent bond, bond to bee given unto my brother in lawe Henry Hackett

meanetyme

pounds of like English money more to bee payd unto him at his age of twenty three yeares with
forbearance for the same in the meane tyme from my decease And if my sonne John Collins shall
decease this lief before his said legacies shalbee due then my Will is and I doe devise and appoynt the
same unto my sonne William Collins to bee payd unto him W[i]th forbearance as aforesaid att such
tyme as the same legacies should have benne payd to by said sonne John Collins if hee had benne
livinge

Item I give and bequeath unto the poore of the severall parishes of and in the Cittie
of Worcest[e]r the some of Tenn pounds of like money of England to bee distributed at the discrec[i]on
of the severall Church wardens and Overseers of the said parishes

Item I give and bequeathe
unto my loveing Freinds Francis Wilsonne William Cooke, and William Saunders to each and
every one of them twenty shillings a peece to buy each of them a Ringe to weare for my sake

heires for ever All my freehold lands and Tenements in the Cittie of Worcest[e]r and Countie of Worcest[e]r
Neverthelesse for further Corroborac[i]on of thestate thereof unto him and his heyres I doe hereby
give devise and bequeath All and singuler the same my lands and tenem[en]ts wheresoever in the
said Citty and County of Worcest[e]r unto the said William Collins my sonne and to his heyres
and assignes for ever And all the reste of my goods and Cattells unbequeathed after my debts
legacyes, and funerall expences payd and discharged I doe alsoe give and bequeath unto my said
sonne William Collins and make him my said sonne William sole Executor of this my last will and
Testam[en]t And I will and appoint that my loveinge brother in lawe Henry Hackett shalbe gardyan unto
my said sonnes John Collins and William Collins and have the Custody and managing of their estates
and legacyes and Custody of my said sonne William untill he shall accomplishe the age of twenty
one yeares and he to be brought upp att the discrec[i]on of the said Henry (the said Henry haveinge
reasonable allowance for the keeping of the said William And I give to the saide Henry for his paines herein to
be taken the some of Twenty pounds of lawefull money of England And if the said Henry shall
fortune to dye before my said sonnes shall have accomplished their respective ages of twentie
one yeares a peece then I will and appointe the said Mr John Streete, Thomas Hacket and
George Brooke or such of them as shalbe then livinge to be Gardyans unto my said sonnes and take
the Custody and managing of their estates and legacies and keepeing of my said sonne William untill
he shall accomplishe his full age of Twentie one yeares In witness whereof I the said Testator
have hereunto put my hand and seale the daye and yeare above written

Sworn on the Holy Saints of God before Master George Drumond Clerk to well and fathfully administer the same
