Kendall C. Brent

Kendall Carroll Brent (1771-1842) lived in Nelson County, Virginia. His will identifies no descendants of his own; he bequeaths his property for the benefit of his brother Landon H. Brent for his life, then to pass to his nieces and nephews.

In a codicil executed the same day as the Will, Brent appoints Hawes N Coleman (abt.1789-abt.1866) as trustee of his estate for the life of his brother Landon.

Will and Codicil of Kendall C. Brent, dec'd

I, Kendall C. Brent of the County of Nelson, and state of Virginia, do hereby make my last Will and Testament in manner and form following that is to say.
1st. I desire that five or more of my negro men & boys be hired out by my Executors hereinafter to be named, until all my just debts & funeral expenses are paid, and my new house now building is completed and paid for --
2nd. I loan to my Brother Landon H. Brent all of my estate both real and personal of every kind and description whatsoever, for and during his natural life, but it is expressly my will, that no part of the property herein loaned him shall be sold or made lyable in any way for his debts, the profits alone of the estate are to be considered his, for his support, and at his disposal --
3d. After the death of my Brother Landon H. Brent, I will and desire that the property which as been herein loaned to him, both real and personal of every description, be disposed of in the following manner.
4th. I give and bequeath to my nephew Landon Brent a son of my brother James D. Brent, my negro man Jo, my negro woman Nancy and her four children, to wit Jenny, Thornton, Rachel and Job, and their future increase, to him and his heirs forever --
5th. I give and bequeath to my nephew James H. Brent, son of my Brother James, one negro to be chosen by himself out of my estate, after the above legacy to his brother Landon Brent Jr is taken out --
6th. I give to my nephew Hugh S. Brent son of my brother James one negro, also to be chosen by himself, after the above mentioned legacys are taken out of my estate -- 7th. I give to my niece Sarah E. Shields daughter of my brother James Brent one dollar and no more, to be paid to her by my executors.
8th. At the death of my brother Landon H. Brent, & after the above legacies are taken out, it is my desire that all the ballance of my etate both real and personal of every description that has been loaned to him in the foregoing part of this will, be divided among the following children of my brother James Brent, to wit: James H. Brent, Hugh S. Brent, Adaline Brent, Fidelia Brent, Frances S. Brent and Margaret Brent, by three commissioners to be appointed by the County Court of Nelson, in the following manner, that is to say, the females are to have equal shares to one another, and the males to have equal shares to one another, but the males to have more than the females, in proportion as four hundred dollars is to three hundred, to them and their heirs forever.
8th. And lastly, I do hereby constitute and appoint my brother Landon H. Brent, my nephew James H. Brent and my nephew Hugh S. Brent, to be executors of this my last Will and Testament, hereby revoking all other or former Will's or Testament's, by me heretofore made. In witness whereof I have hereunto set my hand & affixed my seal, this 6th day of April 1842.

Codicil To this my Last Will and Testament --
All my property both real and personal of every kind and description whatsoever, I give, grant, bequeath and devise to Hawes N. Coleman, for and during the natural life of my brother Landon H. Brent, on this condition and upon this trust, that the said Hawes N. Coleman, shall annually apply the profits of my said estate to the support and maintenance of my said brother Landon H. Brent during his natural life, the said property both real and personal and all the rents and profits of the same to be wholy exempt from all and any liability to the creditors of the said Landon H. Brent, for debts heretofore contracted or that may hereafter be contracted, by my said Brother, and at the death of my brother Landon H. Brent, I desire that the property vested hereby in the said Hawes N. Coleman shall pass to my nephews and nieces, according to the provisions of the foregoing will., the said Trustee Hawes N. Coleman shall not be liable for acts not his own, neither for my executors or my brother Landon H. Brent, only for his own acts or funds that may come into his possession through my executors. Given under my hand and seal this 6th day of April 1842 --

At a Court held for Nelson County, the 27th day of June 1842--
The last Will and Testament of Kendal C. Brent dec'd together with the Codicil thereto, was this day produced in said Court, and proved by the oath of James D. Brent, a subscribing witness thereto, and ordered to lie for further proof. --
and at a Court held for said County the 25th day of July 1842 This Will & Codicil was this day further proved in said Court by the oath of Hezekiah Jones another subscribing witness thereto, and ordered to be recorded, and on the motion of James H. Brent, one of the Executors named in said Will, who made oath thereto, and together with James D. Brent (who qualified as to his competency) his security entered into and acknowledged a bond in the penalty of Fifteen Thousand dollars conditioned according ot law, certificate is granted him for obtaining probat of said Will & codicil in due form.
