This is the last Will and Testament of me
Martha Snelson of Husbands Bosworth in the county of Leicestor Spinster
whereby I dispose of my real and personal Estate in manner following that is
to say / First All that my Messuage Tenement or Dwellinghouse with the
Homestead thereunto adjoining and belonging situate and being in Husbands
Bosworth aforesaid in the occupation of Thomas Wilsey And also all that
Close or Inclosed ground situate and being in Husbands Bosworth aforesaid called
Bales Close containing One Acre and an half or thereabouts / more or less / in the
occupation of the said Thomas Wilsey And also all those Four several
Tenements situate and being in Husbands Bosworth aforesaid in the several
Tenures or occupations of John Bale Robert Hallum Robert Sharp and
Mary Lines I give and devise unto my Niece Mary Heygate and her
assigns for and during the term of her natural life and from and after her
decease I give and devise the said Messuage Tenement or Dwelling house
Homestead Close or Inclosed ground and four several Tenements and premises
unto my Great Niece Mary Ann Heygate eldest daughter of my Nephew
Robert Benjamin Heygate of Market Harborough in the said county of Leicester
Surgeon To hold to her my said Great Niece Mary Ann Heygate her
heirs and assigns for ever Also I give and bequeath unto my said Niece
Mary [erased] Heygate All my Linen and wearing apparel to and for her
own use absolutely Also all and singular other my Monies and securities for Money
household goods furniture plate china chattels effects and personal Estate whatsoever I
give and bequeath unto my three Nephews Thomas Heygate Robert Benjamin
Heygate and John Nicholas Heygate Upon trust to convert such part thereof into
money as shall not consist of Money and to stand possessed thereof together with my
ready money and the money already out upon Interest for the several uses hereafter
mentioned Also all and singular other my Messuages Tenements Closes Lands
hereditaments and real Estate whatsoever and wheresoever I give and devise unto
my three Nephews Thomas Heygate the said Robert Benjamin
Heygate and John Nicholas Heygate their heirs and assigns To hold to them their
heirs and assigns for ever In trust that they or the Survivors or Survivor of them and
the heirs and assigns of such Survivor do and shall as soon as conveniently may
be after my decease sell and dispose of the same either together or in parcels

by Public Auction or Private contract for the most money and best price
or pieces that can or may be obtained for the same and by and with the
money arising from such Sale or Sales after deducting all incidental expences
attending the same to stand possessed thereof together with my ready monies and
the monies arising from Sale of my Personal Estates and the money already
out upon Interest as aforesaid for the uses following (that is to say) In trust
in the first place to pay and discharge all my just debts my funeral expences
and the charges of proving this my Will and then In trust to place out at
Interest the sum of Three hundred pounds upon Government or other good
and sufficient security or securities and pay and apply the Interest dividends
and proceeds arising therefrom unto my said Niece Mary Heygate for and
during the term of her natural life and from and after her decease In trust
to divide the said Principal sum of Three Hundred pounds and Interest
to grow due thereon unto and amongst all and every the Child and Children
of my said Nephew Robert Benjamin Heygate except the said Mary Ann
Heygate to be equally divided amongst them share and share alike when and
as they shall severally and respectively attain their several and respective ages of
Twenty one years to whom I hereby give and bequeath the same accordingly -
Also In trust to pay the further sum of One Hundred pounds unto my
said Great Niece Mary Ann Heygate to and for her own use absolutely
when she attains her age of Twenty one years and also Interest in the
mean time until the same shall become due and payable to whom I hereby
give and bequeath the same accordingly All the rest residue and remainder of
the money then in the hands of my said Trustees In trust to pay and
divide the same unto and amongst my Nephews and Niece the said Thomas
Heygate Robert Benjamin Heygate John Nicholas Heygate James Heygate
Mary Heygate and William Ralph Heygate equally share and share alike to
whom I hereby give and bequeath the same accordingly And I do hereby
declare my Will to be that upon payment of the money to arise by the Sale
or Sales of the said Estates hereby made saleable or any part thereof it
shall and may be lawful for the said Thomas Heygate Robert Benjamin
Heygate and John Nicholas Heygate and Survivors and Survivor of
them and the heirs and assigns of such Survivor to give and sign any receipt
and receipts for the money to arise by such Sale or Sales or any part thereof
respectively which receipt and receipts shall be good and sufficient discharge and
discharges to any purchase or purchasers for so much of the said purchase

Money as shall be therein expressed to be received and that such purchaser or
purchasers shall not be obliged to see to the application of such purchase money nor
accountable for the loss misapplication or nonapplication thereof or of any part thereof
And Lastly I do hereby nominate constitute and appoint my said Trustees the
said Thomas Heygate Robert Benjamin Heygate and John Nicholas Heygate
joint Executors of this my Will hereby revoking and making void all former and other
Will and Wills by me at any time or times heretofore made declaring this and this
alone to be and contain my true last Will and Testament In Witness whereof
I the said Martha Snelson the Testatrix have to this my last will and Testament
continued in three sheets of paper set my hand and Seal to wit my hand to the
two preceding sheets and my hand and seal to this third or last sheet the Thirteenth
day of November One thousand eight hundred and Seventeen

Let aprobat be made to Thomas Heygate of Mansfield in the County of
Nottingham Cotton Spinner. Robert Benjamin Heygate of Market Harbro
Leicestershire Surgeon and John Nicholas Heygate of Manchester in the
County of Lancaster Merchant the joint Executors named in the will of the
within named Martha Snelson who died at Husbands Boswath on the 30th
November last

They being duly sworn as well to the faithful Execution of the
Will as that the Testator's Good Chattels & Credits as they were at
her death without deducting any Debts owing by her therefrom
do not amount in value to the sum of six hundred pounds
