In the name of God Amen. The
sixteenth day of December in the year of our Lord God sixe hundred,
fiftie and two. I Michaell Whitfoott of Hapton in the Countie of Norfolk gent,
being of good and p[er]fect minde and memorie (thanks be given unto god for it)
doe ordaine and make this my last will and testament in mann[er] and forme
following:
First and before all other things, I committ and commend my soule into
the hands of Almighty God my heavenly father steadfastly believing that
thorough the merritts and Death of Jesus Christ my only Saviour my sinnes
are thoroughly washed away and p[ar]doned: And my body I comitt to the earth to
be interred in the p[ar]ish Church of Hapton aforesaid: And concerning those
worldly goods which it hath pleased god to bestowe upon me I dispose of them
as followeth.
Imprimus I give and bequeath unto Barbary my dearly beloved
wife, All those my freehold howses and landes lying and being in the Townes
of Hapton, Fundenhall, Florden or else where within the Countie of Norf[olk] duringe
the time and terme of her naturall life quietly To have, hold and enioy the same.
And from and after the decease of Barbary my wife I give and bequeath All my
howses Landes and Tenements whatsoever lying and being in the Townes of
Hapton, Fundenhall, Florden or else where within the Countie of Norf[olk] unto
Daniel Whitfoote my sonne and the heires of his body lawfully to be begotten
upon Condition that he the said Daniel or his heires shall pay or cause to be
paid out of the foresaid Landes and tenements unto Martha Whitfoott my
daughter her heires or Assignes the some of two hundred pounds of lawfull
money of England, one hundred pounds thereof to be paid within one yeare
next after he or they shall come to enioy the said Landes and tenements, And
the other hundred pounds the next yeere following after that, att the porch
of the p[ar]ish Church of Hapton aforesaid: And for default of payment of the
said two hundred pounds, or any p[ar]t or p[ar]cell thereof to be paid by my sonne
Daniel Whitfoott or his heires unto Martha Whitfoote my daughter her
heires or Assignes: Then I give and bequeath unto Martha Whitfoote my
daughtereighteene acres and one parte of the foresaid Lands lying and being
in Croston Furland in Hapton aforesaid.: And also twelve acres more of the
foresaid land incloses abutting upon Flodderdicke Feild in Haxton aforesaid
for the said Martha my daughter and her heires for ever
Item I give and
bequeath uno Barbary Turner the daughter of Barbary my now wife
the some of Twentie pounds of lawful English money, to be paid by my sonne
Daniel or his heires within three yeeres next after he or they shall come to
enioy my said Lands and tenements so by me given as aforesaid:
Item I give and
bequeath unto Thomas Turner the sonne of Barbary my now wife the some
of Twentie poundes of like lawfull English money to be paid by my sonne
Daniel or his heires within foure yeeres next after he or they shall come to
be possessed of the foresaid Lands and tenements: And if it shall please God
that my sonne Daniel Whitfoote shall de[pa]rte this life not leaving an heyre
of his body lawfully begotten: Then I give and bequeath unto Martha
Whitfoote my daughter, All that my howses lands and tenements
formerly given and bequeathed unto my sonne Daniel, To her the said
Martha Whitfoote and her heyres for ever; Upon Condic[i]on that she the
said Martha or her heires shall pay or cause to be paid out of my foresaid
lands and tenements unto Barbary Turner the daughter of Barbary my
now wife or her heires, the some of one hundred pounds of lawfull English
money at two severall payments Vidz{it} fiftie pounds within one yeere next
And the other fiftie poundes the next yeere following that. And likewise
I give and bequeayj to be paid out of my foresaid landes and tenements by
my said daughter Martha Whitfoote or her heyres if she or they shall
live

live to enioy the same unto Thomas Turner, the sonne of Barbary my now wife
or hir heirs, the some of one hundred pounds of lawfull Englaish money as Two
severall payments, vidz fiftie poundes to be paid within three yeeres next after
Martha my said daughter shall come to enioy my said lands and tenements, And the
other fiftie pounds the next yeere following the foresaid three yeeres
Item I
give and bequeath to be paid out of my foresaid lands and tenements by my
daughter Martha or her heires if she or they shall come to enioy the same, unto
the foure daughters of Edmond Whitfoote my brother the some of foure score
pounds of lawfull English money, That is to say to each of them twenty pounds
a peece:
Item I allsoe give and bequeath unto the two children of my late sister
Wildman the some of Twentie pounds of lawfull English money to be equally
devided betwene them: All which severall somes, to be paid unto them, and
every of them as they shall attaine unto their severall ages of one and twentie
yeeres:
And if in case it should please God that both my said children Daniel
and Martha Whitfoote shall dep[ar]te this life before such time as, they or either
of them shall come to enioy my said Lands and tenements so given as aforsaid not
leaving issue behind them of their or either of them bodyes lawfully to be
begotten: Then I give and bequeath All my said houses lands and tenements
whatsoever wih their appurten[a]nces standing lying and being in the Townes
of Haxton, Fundenhall, Forden or else where within the County of Norf[olk] unto
Barbary Whitfoote my now wife and her heires for ever Upon Condition that
she the said Barbary my wife her heires or Executors shall pay or cause to be
paid within five yeeres next after she or they shall come to have, hold & enioy
all my said houses, landes and tenements as aforesaid, the some of five hundred
pounds of lawfull English money unto the foure daughters of my foresaid
brother Edmund Whitfoote And the two children of my late sister
Wildman, that is to say; one hundred poundes a peece to the four daughters
of my said brother Edmund, And fifty pounds a yeere to each of the children
of my said late sister Wildman: if they be then liveing every of the said five
yeeres to pay one hundred pounds beginning at the eldest, and ending at the
youngest:
Item I give and bequeath unto my deare mother one gold ring of
twentie shillings price if she be then living:
Item I give and bequeath unto
my brother John Whitfoote twentie shillings to buy him a Ring:
Item I give
and bequeath unto my brothers Edmund and Phillip Whitfoote, to each of them
twentie shillings to buy them Rings;
Item I give and bequeath unto Mr
Wale minister of Haxton forty shillings if then instant in officiating at Hapton
Item I give and bequeath unto Elizabeth my late servant now the wife
of Edw: Wip[er]s? Teen shillings:
Item I give and bequeath unto the poore of
the Church of Hapton Teen shillings:
Item I give and bequeath unto the poore people
of the p[ar]ish of Hapton Teen shillings:
Item I give unto Elizabeth Henry
Teen shillings:
All these last written legacies so by me given and
bequeathed as aforesaid I will shall be paid by Executrix here after
named within three monthes next after my decease; All which said
some or somes of money soe by me given and bequeatheed to any p[er]son or
p[er]sones in this my last will and testament. I will shall be paid in the
porch of the p[ar]ish Church of
Hapton aforesaid within the time therin
lymitted;
Item I doe make ordaine, constitute and appoint Barbary
Whitfoote my wellbeloved wife sole Executrix of this my last will and
Testament, unto whome I give All the residue of my goods (not heretofore
given and bequeathed) money, plate, household stuffe, and ymplements of
household towards the payment of my debts, and bringing of my body decently to the
earth.
In witness that this is my last will & testam[ent] being written in foure sheets of pap[er]. I
..... to each of them set my hand & to the last of them my hand and seale & published it to be my
