Will of Peter Brickey, Sr.
Peter Brickey I (abt.1715-bef.1787)'s will passed probate on 16 Sep 1786 in Westmoreland, Virginia, United States.[1]
Botetourt County, Virginia, Will Book E, pp 764-766. Transcribed by Linda Jonas[2][3]:
"In the name of God amen I, Peter Brickey Snr. of the County of Botetourt being frail and calling to mind the uncertainty of human life and being desirous to dispose of such worldly estate as it hath pleased God to bless me with, I give and bequeath the same in manner following, that is to say etc.
Item 1. I desire that my burying and funeral expenses to be paid and all my just debts.
Item 2nd I desire all the perishable part of my estate to remain in the hands of my wife Elizabeth Brickey until my youngest child comes of age.
Item 3d I bequeath my son William Brickey, Rachel a slave and her increase forever.
Item 4th I bequeath my daughter Elizabeth McKenny a female slave named Judah and her increase forever.
Item 5th I bequeath my daughter Mary Jones a female slave named Jane forever.
Item 6th I bequeath my son Daniel Morgan Brickey a female slave named Milly and her increase forever.
Item 7th I bequeath my daughter Ann Slinker a male servant named Samuel to her and her heirs forever.
Item 8. I bequeath my son Samuel Brickey one female slave named Delia and one male slave named Alfred and one horse worth $60. And my son William and Daniel each had a horse apiece worth $60. I give Samuel to [sic] slaves because he is a cripple.
Item 9th As for Jonathan Lee I have done him many past favours. I do bequeath his wife Sarah Lee five pounds after my decease.
Item 10th I bequeath my son Peter Brickey one male slave named Peter and a horse to him and his heirs forever
Item 11th I bequeath to my son John Brickey a male slave named Gabriel and a horse worth $60 to him and his heirs forever
Item 12th I bequeath my daughter Agness Lee a female slave named Sally and her future increase to her children forever, and when the youngest child comes of age, said slave and her increase shall be sold and divided among the children provided they can't agree upon a division themselves.
Item 13th I bequeath to my son Jarred Brickey a male slave named James and a horse to him and heirs forever which horse I gave him $75 for.
Item 14th I bequeath to my daughter Temperance Barnes a female slave named Silvy and her future increase forever.
Item 15th I bequeath to my son Elijah Brickey a male slave named Andrew and a horse worth $60 to him and his heirs forever.
Item 16. I bequeath to my daughter Dorcas Lefler a female slave named Caroline and her future increase to her and her heirs forever.
Item 17th I bequeath my son George Washington Brickey a male slave named Edmund forever.
Item 18th I bequeath to my son Andrew Jackson Brickey a male slave named Elias forever.
Item 19th I bequeath Martha Elizabeth Susannah and Jane Dun a bed apiece provided they stay with us until they marry.
Item 20th I bequeath my grand son James Allen Brickey $60 which is to come out of my son Elijah Brickey part of my estate
Item 21st And if there should be any more heirs by my wife while I live I bequeath that they shall be made equal with the rest George Washington and Andrew Jackson Brickey
Item 22d It is my desire that if my wife cannot rule or govern the negroes she shall complain to the executors and they shall be hired out by them for the benefit of her and the children.
Item 23rd I desire that my servant Molly stay on my place and be free after my decease and if not able to support herself she shall have support out of my estate
Item 24th My desire is that all things shall stay together on my place till my youngest child comes of age and then my wife shall have the third of the land where she pleases or sell the land if she pleases and she to have the third part of the money
Item 25th My First wife's children has received all the above named property except my daughter Sarah Lee. She is to get five pounds after my decease.
In witness whereof I have hereunto set my hand and affixed my seal this thirteenth day of April in the year of our Lord One thousand eight hundred and thirty six.
And lastly I do hereby constitute and appoint my friends Frederick Wimman and John Vandergrift executors of this my last Will and Testament hereby revoking all other or former Wills or Testaments by me heretofore made. In witness whereof I have hereunto set my hand and affixed my seal this 13th day of April 1836. [signed] Peter (his X mark) Brickey (seal)
Signed sealed published and declared by Peter Brickey Snr as and for his last Will and Testament in the presence and hearing of us when at his request and in his presence have subscribed our names as Witnesses.
Teste Thomas Moore, Elijah M. Lee, Martha (her X mark) Dun, Mary J (her X mark) Dun, John Hamman, Thomas H Burns.
At Botetourt November Court 1836 This testament of writing purporting to be the last Will and Testament of Peter Brickey deceased was exhibited in Court and on motion to admit the same to record it is ordered to be docketed and continued till the next Term, and at the August Court 1837 this said instrument of writing purporting to be the last will and Testament of the said Peter Brickey deceased bearing date the 13th day of April 1836 was this day again produced in Court by Elizabeth Brickey the widow of said Peter Brickey in order to be proved and Jonathan Lee appeared and opposed the proof of the said Will Whereupon divers witnesses were sworn and examined and the parties aforesaid by their Counsel fully heard
On consideration whereof it is the opinion of the Court that the said Peter Brickey, deceased, at the time of executing the Writing aforesaid was of sound and disposing mind and memory and that he was under no undue influence and Thomas H. Burns, Thomas Moore and John Hamman the subscribing witnesses to the said writing having testified in Court that the said Peter Brickey acknowledged and published the same in their presence as and for his last Will and Testament that they subscribed their names as witnesses thereto in the presence of the said Testator and at his request and that the said Testator was of sound sense and memory as far as they knew or believed. It is ordered that the said Writing of the 13th day of April 1836 be recorded as the last will and testament of the said Peter Brickey, deceased. A Copy Teste. Wm M Lackland DC"
