State of ILLINOIS,
Schuyler County, SS. In the Schuyler County Court. In Probate October Term, A.D. 1901.
On Saturday the Twelfth day of October in the year of our Lord
one thousand Nine hundred and One.

IN THE MATTER OF THE ESTATE OF
Philip S Burmood DECEASED, PROBATE OF WILL
NOW, on this day comes James Wallace Burmood and surrender to the Court an instrument in writing purporting to be the Last Will and Testament of the said Philip S Burmood deceased, which is ordered by the Court to be filed. And the Court having heard said petition read, and being fully advised in the premises, it is ordered that this cause be set for hearing on Friday the Thirteenth day of November A.D. 1901 at Ten o'clock A.M.

IN THE MATTER OF THE ESTATE OF
Philip S Burmood DECEASED, PROBATE OF WILL
NOW, on this day, this cause coming on for further hearing by the Court, thereupon comes James Burmood which proof is ordered by the Court to be entered of recrod. And the Court finds from the allegations in said petition contained, and from the evidence adduced in open court, that the following named persons are all of their at tlaw and legatees of the said Philip S. Burmood deceased, to-wit: Sarh Lucinda Burmood - James Wallace Burmood - Almeda McCreery - Bessie Robinson and Virginia Alexander
and that each of the said named heirs at law and legatees of said deceased, whose post-office address is known to said petitioner and shown in said petition, has been duly notified of the pendency of this proceeding by a copy of said petition, mailed to them by the Clerk of this Court in time and manner as required by law, and that each of the said named heirs at the Clerk of this Court in time and manner as required by law.
AND NOW COME W. H. Mead and W. E. Hillyer subscribing witnesses to the aforesaid instrument of writing, and bieng first duly sworn, testify to the due execution of said instrument by the said Philip S. Burmood deceased, and that at the time of the execution of said instrument said witnesses believed said testator to be of sound mind and memory, and under no constraint, which testimony is ordered by the Court to be entered of record in full. And the Court being now fully advised in the premises, it is ordered that the said instrument be and the same is hereby declared to be the duly and sufficiently proven and authenticated as the true Last Will and Testament of the said Philip S. Burmood deceased. And it is further ordered that the said will be entered of record.

Schuyler County, SS. James Burmood being duly sworn, deposeth and saith that Phillip S. Burmood late of the Town of Huntsville in the County of Schuyler and State aforesaid, departed this life at His Home in said County, on or about the 25th day of September A.D. 9101, and that He died leaving a Last Will and Testament, to the best of His knowledge and belief.

Personally appeared in open court W. H. Mead and Philip S. Burmood subscribing witnesses to the annexed instrument of writing, purporting to be the Last Will and Testament of Philip S. Burmood late of said County, deceased, who, being duly sworn according to law, does depose and say, each for him self, that he was present and saw the said

and that they believe that the said testator was of sound mind and memory, of lawful age, and under no constraint when he signed said Will.

Last Will and Testament of Philip S Burmood Deceased.
I, Philip S Burmood of Huntsville in the county of Schuyler and State of Illinois, being of sound mind and memory, do make and delcare this to be my last Will and Testament.

  • FIRST: I desire that my funeral expenses and all my just debts be fully paid.
  • SECOND: I give devise and bequeath to my beloved wife Sarah Lucinda (Hood) Burmood all of my property both real and personal of whatever kind, description or wherever situate to have and to hold during her natural life, and from and after the deceased of my said wife to go to my children viz: Almeda McCreery, Bessie Robinson, Virginia Alexander and James Wallace Burmood, to have and to Hold share and share alike to them and to their heirs and assigns forever.
    Nevertheless it is my will that James Wallace Burmood shall have to be applied toward his portion of said Real Estate the Eighty Seven (87) Acres of land, being Lot Number Two (2) of the NorthWest Quarter of Section Number Three (3) also Lot Number One (1) on the East Half of the North East Quarter of Section Number Four (4) in Township Two (2) North of Range Four (4) West of the Fourth principal meridian in the County of Schuyler and State of Illinois (Known as the Home Farm).
  • THIRD: It is my will, that at the time of the decease of my said wife, that my Executor hereinafter named shall pay out of my estate the sum of One Thousand Dollars to James Wallace Burmood his heirs and assigns.
  • FOURTH: I heareby constitute and appoint James Wallace Burmood Executor of this my Last Will and Testament.

In witness whereof I, Philip S Burmood have hereunto set my hand, this twenty First (21) day of October A.D. 1899.
