The Will of Samuel Woodward bricklayer of West Bromwich was written on 14 November 1839 and proved on 27 March 1840, in the Diocese of Lichfield Episcopal Consistory Court, with administration to Hannah the relict. further administration was granted to Samuel Woodward the son and surviving executor on 8 October 1858. This is the last will and testament of me Samuel Woodward
of West Bromwich in the County of Stafford Bricklayer I
give devise and bequeath unto my wife Hannah All my
household goods and furniture money securities for money
tools and all other my personal estate and effects of every
description And also all my messuages tenements or
dwellinghouses lands hereditaments and real estate whatsoever
and wheresoever with their several appurtenances To hold
to her my said wife and her assigns for and during the term of
her natural life and for her own use and benefit And
I do hereby will and declare that it shall be lawful for my
said wife in case she shall be desirous of so doing to sell
and absolutely dispose of all or any part or parts of my
said real and personal estates and effects either by public
auction or private contract and in such way and manner
as she in her sole discretions shall think proper and convey
the same to the said purchaser or purchasers thereof or as he she
or they may direct and give receipts for the purchase money
which shall exempt the said purchaser or purchasers from
being obliged to see to the application of such purchase money
And I further will and declare that my said wife may pay
or apply the monies to arise or be produced from such sale or
sales to and for her own use and benefit or otherwise as
she may think proper And from and after the decease of
my said wife then as to all my said household goods and
furniture money securities for money tools and other personal
estate and effects And also as to all my said messuages tenements

or dwellinghouses lands hereditaments and other real estate (or
so much and such part or parts thereof respectively as she
my said wife shall not have sold and disposed of in her
life time pursuant to the power hereinbefore contained for
that purpose) I give devise and bequeath the same and
every part thereof together with any monies which may then
remain unapplied or undisposed of arising from the sale
of any part or parts of my said real and personal
estates and effects by my said wife in her life time unto my
sons James and Samuel To hold to them and the survivor
of them his heirs executors administrators and assigns
according to the tenure nature or quality of my said real
and personal estates effects and premises respectively But
upon the trusts and for the ends intents and purposes hereinafter
declared thereof (that is to say) Upon trust that they my said
sons James and Samuel or the survivor of them his heirs
executors administrators or assigns do and shall as soon as
conveniently may be after the decease of my said wife sell
and absolutely dispose of such part or parts of my said
real and personal estates and effects as shall not consist
of money and collect get in and receive all such part or
parts thereof as shall consist of money or securities for
money such sale or sales to be by public auction or
private contract and in such lot or lots as they my said
trustees or trustee shall think proper And I will and
direct that the receipt or receipts in writing of my said trustees
or trustee for the time being shall be good and sufficient

discharges for the said purchase money And that such
purchaser or purchasers shall not afterwards be obliged to
see to the application of such purchase money or be responsible
for the loss misapplication or nonapplication of the same
And I will and direct that my said trustees or trustee shall
stand possessed of and interested in the monies to arise and
be produced from such sale or sales as aforesaid and to be collected
got in and received from my said persona; estate and effects
Upon trust in the first place to pay and discharge my debts
funeral and testamentary expenses and also the funeral
expenses of my said wife And upon trust to pay distribute
and divide the residue or overplus of such trust monies
unto between and amongst my children Isaac, Sarah,
Jane, Aaron, Samuel, Harriet, Eliza and James
equally share and share alike to and for their own
absolute use and benefit respectively and lastly I
hereby appoint my said wife and my said sons James
and Samuel joint Executors of this my will and hereby
revoking all other wills by me heretofore made I do declare
this to be my only true last will and testament In
Witness whereof I have hereunto subscribed my hand
this fourteenth day of November 1839.

the Will of Samuel Woodward late of West
Bromwich in the County of Stafford deceased who died
on the 16th day of December 1839 at West Bromwich
aforesaid was proved in the Principal registry
of Her Majesty's Court of Probate by the oath of
Samuel Woodward of West Bromwich aforesaid
Builder the son of the deceased the surviving
Executor therein named he having been first sworn
duly to administer The said Will having been
originally proved in the Consistory Court of Lichfield
by the oath of Hannah Woodward Widow the
Relict of the said deceased one of the Executors
therein named A power being reserved of making
the like grant to James Woodward the son also
of the said deceased and the said Samuel Woodward
the other Executors.
