This is the last Will and Testament of me Thomas Brooks of Blaby in the County of
Leicester Framework Knitter as follows All that my messuage or Tenement with the appurtenances
thereunto belonging situate standing & being in Blaby aforesaid now in my own occupation and all
other my real estate whatsoever and wheresoever I give and devise unto my wife Mary Brooks and
her assigns for and during the term of her natural life she keeping the same in tenantable repair
and from and immediately after her decease I give and devise my said Messuage or Tenement
with the appurtenances and all other my real estate unto my nephew Thomas Marston of Enderby
in the said County his heirs and assigns for ever Subject nevertheless to and charged and chargeable
with the payment of the following Legacies or sums of money to the following persons vizt To my
Nephews John Frost and Thomas Brooks and to Ann Brewin my said Wife's Sister the respective
sums of ten Pounds apiece and I do hereby direct the same to be paid to them respectively at the
expiration of twelve months next after the decease of my said Wife but if any of them shall be then
dead then it is my mind and will that the legacy or legacies of him her or them then dead shall not
be paid but sink into my said Messuage or Tenement and real estate for the benefit of my said
Nephew Thomas Marston Provided always nevertheless that in case my said Nephew
Thomas Marston shall die in the life time of my said wife - that then it is my mind and
will that my said messuage or tenement and real estate shall go and I do hereby in such case
give and devise the same unto the heirs and assigns of my said Nephew Thomas Marston
for ever subject nevertheless to the payment of the Legacies hereinbefore given to the said John
Frost Thomas Brooks and Ann Brewin in manner and at the time aforesaid but not otherwise
Also I give and bequeath unto my said wife one Stocking Frame No3 24 Gage for her own
use Also all other my stocking frames I give unto my said Nephew Thomas Marston Upon
trust that he my said Nephew his Executors or Administrators do and shall let and set the same
in the best manner he or they can and after keeping the same in sufficient repair out of the rents
arising therefrom do and shall pay the surplusage of such Rents unto my said wife or permit her
to receive the same for and during the term of her natural life and from and after her decease
Then it is my mind and will and I do hereby give all the said last mentioned stocking frames
unto my said Nephews the said Thomas Marston John Frost and Thomas Brooks in equal
shares and proportions or to such of them as shall be living at the decease of my said wife and
the issue of such of them as shall be then dead leaving issue such issue to take in equal
proportions but such share or part only as his or their parent or parents would have ^taken if then living
Also I give and bequeath unto my said Nephew Thomas Marston the sum of twenty five
Pounds now out at Interest Upon trust that he my said trustee his Executors or Administrators

do and shall either continue the same out at interest on its present security or call in and replace the
same out at interest on such other security or securities as he or they may think proper and do and shall
pay the interest dividends and produce thereof as received unto my said wife or permit her to receive the
same for and during the term of her natural life and from and immediately after her decease Then
upon further trust that he my said trustee his Ex[ecut]ors or Adm[inistrat]ors do and shall pay and equally divide the
said principal sum of twenty five Pounds and all the accruing interest thereof unto and equally amongst
my said Nephews the said Thomas Marston John Frost and Thomas Brooks or such of them as shall
be living at the decease of my said wife and the issue of such of them as shall be then dead leaving issue
such issue to take in equal proportions but such share or part only as his or their parent or parents would
have taken if then living
Item all my household goods and furniture plate linen and china and
all other my personal estate not hereinbefore disposed of I give and bequeath unto my said wife
for her own use and benefit absolutely And I do hereby declare that the said Thomas Marston
his Ex[ecut]ors or Adm[inistrat]ors shall not be charged or chargeable with or accountable for any more of the said
Estate and effects than what he or they shall receive by virtue of this my will^
^any otherwise than for such sum or sums of money only as he or they
shall actually receive and that none of them shall be answerable or accountable for any involuntary
loss whatsoever of such trust premises or any part thereof and that he the said Thomas Marston
his Executors or Administrators shall and may out of such trust monies and premises
be allowed to retain to and reimburse himself and themselves all such charges damages and expences
as he or they shall sustain or be put unto in and about the Execution of the trusts of this my will
And Lastly I do hereby appoint my said wife Mary - Brooks and my said Nephew
Thomas Marston joint Executors of this my last Will and testament In witness whereof and that
I do hereby revoke all former wills by me at any time heretofore made I have to this my last Will
and Testament contained on two sheets of paper to the first sheet thereof set my hand and to this
second and last sheet thereof my hand and seal the fifth - day of January - in the Year of our
Lord one thousand eight hundred and five.
