This Tenth day of the fifth month comonly
called July in the four[th] and twentieth yeare of the
reign of King Charles the second of England for and in
the year of our Lord one thousand six hundred seaventy
and two. I William Lyncolne of Hingham in the
county of Norf[olk ] yeoman doe ordayne & make this my
last will and testament in manner & forme following that is to
say First I give & bequeath will and devise all my
lands & tenements unto Dorothy my wife & to her
assignes for and during the term of her naturall
life Upon condition notwithstanding that she the
said Dorothy or her assignes shall pay or cause it be
paid All such sumes of lawfull money of England
unto such persons & at such times & places as and
hereafter & herein mentioned & declared that is to
say unto John Lyncolne my kinsman tenne pounds
of like lawfull money to be paid unto him the said
John his Ex[ec]utors Adm[inistrator]s or assignes within one whole
yeare next after my decease & at the house wherein
I now dwell. And unto Mary Johnsonne my
kinswoman tenne pounds of like lawfull money
to be paid unto her the said Mary her Executors
administrators or assignees within two whole yeares
next after my decease snd at the house wherein
I now dwell. And unto Esther Goldin my
kinswoman five pounds of like lawfull money
to be paid unti her the said Esther her Ex[ec]utors Adm[inistrator]s
or assignees within three whole yeares next after my
decease and at the house wherein I now dwell.
And unto Joseph Nobbs my kinsman five pounds
of like lawfull money to be paid unto him the said
Joseph his Ex[ec]utors Adm[inistrator]s or assignes within foure
whole yeares next after my decease and at the house
where I now dwell. And if it shall happen that
default be made in payment of the severall and
respective sumes of money before herein appointed and
ordered to be paid in manner and forme aforesaid that
then & from thenceforth it shall and may be lawfull
to & for the partye and partyes to whom such default
shall happen to be made as aforesaid unto all & singular the
said lands & tenements before herein given unto Dorothy my
wife and to her assignees To enter & the same to have hold
possess & enjoy to their & every of their respective use
& benefitt to whom such default shall happen to be
made be fully satisfied contented & paid out of the rents
issues & profitts of the same lands & tenem[en]ts the several
& respective sumes of money aforesaid to them & every of
them respectively given limitted declared or devised herein
& hereby. Item I give & bequeath will & devise unto
the aforesaid John Lincolne my kinsman & to his
assignees for & dureing the terme of his naturall life
All that Inclose which is next the barne w[i]th barne
I purchased of one Thomas Burman & part of the
Inclose was part of the aforesaid Thomas Burman
purchased & part of one Grace Fleetwood and her
sister Elizabeth Fleetwood. Upon condition
notwithstanding that he the said John Lincolne or
his assignees shall pay or cause to be paid unto William
Lincolne his brother the sume of five pounds of
lawfull money of England to be paid unto him the
said William his Ex[ec]utors Adm[inistrator]s or assignes within one
whole yeare next and immediately after my wife’s
decease in or at the Markett house in Hingham
aforesaid. Item I give and bequeath will & devise
unto the aforesaid Mary Johnsonne my kinswoman
and to her heyres all that other part of the Inclose
which I lately purchased of the aforesaid Thomas
Burman which I lately divided by a ditch & quick sett
from that formerly herein & hereby given & bequeathed
to my aforesaid kinsman John Lincolne. Upon
condition notwithstanding that she the said Mary
or her assignees shall pay or cause to be paid unto
Stephen Lincolne her brother the sume of five
pounds of lawfull money of England to be paid
unto him the said Stephen his Ex[ec]utors Adm[inistrator]s or
assignees within one whole yeare next & immediately
after my wife’s decease in or at the Markett
house in Hingham aforesaid. Further my mind
and will is that if the aforesaid Dorothy my wife
shall depart this natural life before the legacyes
& severall bequests herein given & hereby willed &
devised shall become due unto the aforesaid Ester
Goldin & Joseph Nobbs my kinswoman & kinsman
& shall become payable That then my mind and
will is that the aforesaid John Lincolne my kinsman and
the aforesaid Mary Johnsonne my kinswoman
shall each of them pay or cause to be paid the
severall & respective funds of money before herein
willed & devised & hereby given & bequeathed unto
the aforesaid Esther Goldin & Joseph Nobbs & to
their & either of their several & respective executors
administrators or assignees in such manner & form
as is before expressed and declared and under
such conditions & provisoes as and therein and
thereby men[ti]oned & contayned. Item further
my mind & will is that the aforesaid Dorothy my
wife shall not plow digge up or convert into tillage
any of the aforesaid lands, which if she or her
assignees shall for doe that then it shall & may be
lawfull to & for him or her upon whose land the
forfeiture shall be made to enter & to hold upon
such conditions as is before expressed any thing
before herein to the contrary in any wise notwithstanding
And further my mind and will is that if the aforesaid
Barne shall by casualty be burnt or by extraordinary
wind be blown down, she shall not be compelled or
injoyned to build it up again, which if they shall for
doe my mind & will is that the aforesaid John Lincolne
or whom else shall there take any advantage of Law
shall forfeit to the said Dorothy my wife all their
right & title in the aforesaid land with which the
barne is bequeathed to the aforesaid John Lincolne
and his assignees. And further my mind is that the
aforesaid Dorothy my wife shall doe all such needfull
& necessary separations as is said fitt for the
upholding & maintayning the said barne in repayre.
Item I give and bequeath forty shillings of lawfull
money of England to be divided amongst the poore
of Hingham aforesaid within one month after my
decease. Item I ordayne & make the aforesaid
Dorothy my wife sole Executrix of this my last Will
and testament contayned in two sheets of paper to the
first whereof I have sett my seale to the labell that
fastens them together & to the last of them my hand
& seale the day & yeare first abovewritten.
