Birth

Daniel was born on October 10, 1687, probably in Staten Island, New York, the third son of Daniel and Mary (Mott). [1][2]

Parents

His father was Daniel Stillwell (baptized November 13, 1653, died about 1720). His mother was Mary (Mott).[1]

Dewitt Stilwell (1914) lists Daniels' parents:[1]

"VII. Daniel Stilwell, baptized November 13, 1653, died about 1720. Married Mary Mott, daughter of Adam Mott."

  • Nov. 25, 1739 Richard, parents Daniel Stilwell, Catherine Lazelier

It has one further entry:[5]

"We append the following, collected chiefly from church records: … Daniel and Maria [Marie?] Stilwell had sons Richard and Daniel, both baptized November 7, 1753."

Last Will

His will probate date was February 14, 1760.[6]

His will dated February 14, 1760, names the following children:[7]

His will dated 14 February 1760 reads:[7]

"In the Name of God Amen the fourteenth Day of February in the year of our Lord Christ one thousand seven hundred and Sixty I Daniel Stilwel of the County of Richmind and Coloney of New York - being very sick and weak in body But of perfect mind and memory thanks be given to God therefor, Calling to mind the mortality of my Body - and knowing that it is appointed tor men once to die Do make and ordain this my last Will and Testament that is to say principally and first of all I give and Recommand my soul into the hands of God that give it and as for my body I Recommand to the Earth to be buried in a Christian like and decent manner at the Discretion of my Executors nothing Doubting but at the general Resurrection I shall Receive the same again by the mighty power of Gid and as touching such worldly Estate as it hath the plan to bless me in this life I give and Dispose of the same in the following manner and form - Imprimis it s my [unknown] I Do order that n the forst place all my just Debts & funeral Charges shall be paid and satisfied I give and Bequeath to Caleron my Dearly beloved wife the use and people for on of all my Eastate Boath Real and personal / Exception what shall be hereafter excepted, untill my son Abraham shall arrive to the age of twenty one (if she Remain so long my widow) together with the just and full Sum of one hundred Pounds current money of New York all which I give her in Liou and mistead of her Right of Power and power of Thirds to my Real Estate.
"Item I give and bequeath to my Son and Heire Richard Stilwell that part of my Farm or plantation which is below the Road that leads from the smoaking Point to the fresh kill and meadow (excepting three acres of tall meadow which I purchased of John Brown) and five acres of woodland lying next to the Sand of Finis van poll to him and ti his heirs and assignes for loo he paying to his brother Daniel the Just and full Sum of one hundred and seventy pounds current money ava foresaid when the Plantation comes into his possession. Hem I give and bequeath unto my Son Nicholas Stilwell all that part of my farm that lyes above or on he South side of the above-mentioned Rad (exception the five acres before mentioned give to his Brother Richard), and three acres of Salt Meadow which I purchased of John Brown to him my said Son Nicholas and to jus heirs and assignes forever he paying to his Brother Abraham the sum of one hundred and seventy pounds current money as above said when the Plantation comes into his possession.
"Item I give and Bequeath to my Daughter - Caleron the sum of one hundred pounds and my Negro Girl called flora.
"Item I give and Bequeath to my Daughter Hester the Sum of one hundred pounds and my Negro Girl called Sarah.
"Item I give and bequeath to my Daughter Mary the Sum of one hundred pounds and my Negro Girl called Marie.
"Item my will is that all the Remainder of my Estate lett the same Consist of what it will shall be Equally shared and divided amongst all my Children share and share alike and in Case Either of my Children should Bye under age and without lawfull share then his her or their part of portions shall be Eaqually shared and Devided amongst the Survivors of my Children theirs heirs and assigns, My Will is that in Case my wife should marry befor my Son Abraham shall arrive to the age of twenty one, then she shall take her legasy of one Hundred pounds above mentioned and quit and remove off my Estate at which time my Sond Richard and Nicholas shall take the possession of my Estate and pay the Leggasies to their two Brothers as above mentioned which if they shall refuse my Executor either of them shall have full power and authority to sell my land or vo make thereof as the shall think proper to pay the Legasies as above mentioned and their his or her Deed or Deeds shall be lawfull and authentick to the purchaser or purchasers and lastly I hereby nomenate constitute and appoint Caleron my Dearly Beloved Wife Executrix and my trusty Friend and father in Law Nicholas Larzelear and my Son Richard Stilwell Executors of this my last will and testament Ratifying allowing and Confirming theis and no other to be my last will and testament in witness whereof I have hereunto sett my Hand and Seal the Day and Date first above written / the word five being first Razed out which stands Between the twentyeth and twenty second line --
"Daniel Stillwel [DS] Signed sealed published pronounced and declared by the said Daniel Stilwell as his Last Will and testament in the presence of us the Subscribers Benj. a Seaman Saxton Parmar Junr. Joseph vn pelt.
"Richmond County [...] Be it Remembred that on this tenth Day of December one thousand seven hundred and Sixty personally came and appeared before me Benjamin Seaman Surrogate of the Conty of Richmond aforesaid Saxton Parmer Junr. Boatman ad Joseph Vanpelt Labourer Boath of R. County and being duly sworn on their oaths Declared they they and each of them did see Daniel Stilwell Sign and Seal the within written Instrument purporting to the the will of the said Daniel Stilwell bearing Date this fourteenth Day of February one thousand seven hundred and sixty and heard him publish and declare he same as and for his last will and testament: that all the Time thereof he this said John and [...] was of sound disposing and mind and memory, to the best of the knowledge and belief of them the deponants; and that their makes subscribed to the said Will, are of their own proper hands writing, which they subscribed as witnesses to the said will in the testators presence And that the the Deponants Rebecca Andrevet the other witness to the said will Subscribe her Name as witness thereto in the testators presence.

Research Notes

Sources contain conflicting information and appear to combine the details of two different Daniels who were about the same age.

A Daniel Stillwell was married to Marie Poillon before 1731 (the year when their daughter Francyntje was baptized). This is likely a different Daniel Stillwell, born 1696, son of Thomas and Ann Hubbard Stillwell. Also, none of the children of Daniel and Marie are listed in the will shown here.[4] [8]

Stilwell, B. M. (1878) writes: [2]

"3. DANIEL STILWELL, (third son of Daniel) (E), born, Oct. 10, 1687, married Catharine Larzalier, settled in Morris County, New Jersey, where he died intestate, in 1766. See letters of administration, Liber 1, p. 7, Trenton N. J. Left one son:
A. Richard Stilwell, born Nov. 22, 1739."

The claim that Daniel lived and died intestate in New Jersey appears incorrect, because:

  • baptism records of his children were in Staten Island, New York (not New Jersey),
  • he did not die intestate (he left a will),
  • his will mentions his property near Smoking Point and Fresh Kills, which are both in Staten Island (not New Jersey).

It is likely that a different Daniel lived and died intestate in New Jersey, possibly [[Stillwell-1322|Daniel who married Mary Poillon].

Bergen, T. (1881)[9] writes that Daniel's father was not Daniel, but Thomas:

"Thomas 2nd (s. of Richard 1st [son of Nicholas the emigrant] and Mary), b. Dec. 4, 1666; (sup.) m. 1st Ann Hubbard; (sup.) m. 2nd, 1703, Alice Throckmorton. Left [Gravesend] and settled on [Staten Island]… Issue:—Daniel of [Staten Island], b. 1696, m. Mary Poillion; John, b. 1709; Thomas; and Elizabeth, bp. May 23, 1718. (There may be errors in this issue.)"

Stilwell, B. M. (1878) writes:[10]

  • Daniel born in 1696 [vs. 1687 for our Daniel]
  • father was Thomas (b. 1666, m. Ann Hubbard, d. 1726 Staten Island) [father mismatch]
  • married Mary Poillon of Staten Island
  • had three sons:
    • Joachim (b. 1730, m. [[Tenners-1|Ann Tenners])
    • Daniel (b. 4 Apr 1736, m. Aryt-Anty --------)
    • Jaques (b. 26 Mar 1738).
