Robert Stith was a son of Drury Stith and Fanny Love. He married to Mary Ann Goodwyn, a daughter of Armistead Goodwyn. Robert and Mary Ann were named during the settlement of Armistead's estate in 1819. They were again named in a Chancery suit filed in Greensville County about 1824 by Mary's younger siblings.
Robert appears to have been an insolvent debtor. He appears to have depleted his own inheritance and possibly the inheritance of his wife, after finding himself in custody of the Sherriff of Brunswick in 1820. His brother William Stith died young around 1836 bequeathing 1/2 of his estate to the care of Robert's children. The Brunswick Court thereafter appointed a guardian of the minor children and their assets.
Robert and Mary were last residing in Floyd County, George near several of their married daughters. It is likely they both died in Georgia but dates and burial locations are not known.

On motion of the plt. by her counsel Richard W. Field is assigned guardian to the infant def'ts in this suit. Whereupon this docketed and came on by the consent of the parties to be heard on the Bill, answers, exhibits, and the arguments of counsel. On consideration whereon the Court doth adjudge, order, and decree... The said commissioners shall proceed to value, and to divide in kind, the slaves mentioned in the bill of the estate of the said Wm. Stith, dec'd... Brunswick Court Order Book Vol 35. p. 200.

The Court doth assign William B. Wilkinson guardian to Mary Stith, Amanda Stith, Alethea Stith, Emeline Stith, Robert Stith, and Drury Stith Infant children of Robert Stith and thereupon the said Wilkinson with James H. Gholson, Peter J. Turnbull, & Edward C. Smith his securities entered into and acknowledged a Bond in a penalty of 50,000 dollars with condition according to law.[2]
