Ethel Rose Daniels proceeded against her husband, William McDonald Daniels for maintenance. : Complainant said she had been married about 10 years, and there were 2 children. Defendant managed a produce business in Melrose-st. for his father. About 3 years ago she had to go to the hospital, and as defendant would not support her, she took a situation at Forbes as a cook. She sued him for maintenance, and he got her to withdraw the summons. "She then went to work at Brunswick, and also to Queenscliff and Horsham. She summoned him, and he said he would allow her 5/- a-week, but preferred to live at his mother's place. He said he had a few pounds and would spend it in getting evidence against her. She had never been unfaithful to him. A man once drove her to Brunswick, but nothing improper took place. To defendant's solicitor-I have been a teetotaller for the past six months. I went into an hotel last Saturday night with a jug, but it was for my father. My husband has not complained of my drinking. He often said he was "tired of married life." I went to the hospital because of nervous break-down, and not because I was suffering from alcoholic paralysis. I was not in the Royal Park at night with a man 18 months ago. To her solicitor -When I worked at Brunswick I often walked home through the Park as the evening was closing in. Rose Stowel, mother of the complainant, said she spoke to defendant about supporting his wife, and he said he "'would do nothing, and was very comfortable living with his mother." Andrew McCrae said he knew complainant as Ethel Stowel, but never knew she was a married woman. About eighteen months ago he took her out in a buggy to Brunswick to look for work. Solicitor for defendant- Did not misconduct take place.." Witness-Well I thought she was a single woman, and certain things did transpire. At this stage solicitor for the defendant asked for an adjournment to procure a witness not in attendance, and the case was adjourned for 7 day's.

ADJOURNED MAINTENANCE CASE. The hearing of the claim for maintenance of Ethel Rose Daniels against her husband, William McDonald Daniels, was resumed. The case was adjourned from 19th inst. to allow defendant to get a witness named Walsh. On the case being resumed, solicitor for the defendant, asked that complainant go into the box again. . . In answer to her husband's solicitor, complainant said Forbes and, Prairi Lands N.S.W. were practically the same places. She was there in 1907, and knew a man called Shailer. She was not on loving terms with him, nor did she ever receive a letter from him. Defendant's solicitor then read a letter dated Prairi Land, N.S.W., May 22nd, 1908, beginning "Dear. Ethel," and ending "your affectionate lover, W. F. Shailer" _ In it complainant was addressed in very endearing terms. Complainant-I know a man called Shailer up there but I never wrote to him or was intimate with him. I never got that letter.... " . The bench put defendant in the box, and asked him how he came into the possession of the letter counsel had read. Defendant-It was addressed " Mrs. Daniels," and, was sent to my, mother. Solicitor for complainant - My client denies Mr. McCrae's story of misconduct, or misconduct with anyone. The witness Walsh said he knew nothing against Mrs. Daniels. The chairman--We don't think anything has been proved against Mrs. Daniels' character nor have we any. doubt as to her respectability, and 'there will be an order for 6/- a week with 31/ costs.
