November 23, 1905

central criminal. (Before Mr. Justice Cohen.) Mr. Garland prosecuted for tbe Crown. CHARGE OF CHILD-MURDER. Mary Ann. Wilkinson was charged with the murder of her infant child at St. Peters on No- ; vember 23 last. Accused pleaded not guilty, and was defended by Mr. Coyle (instructed by j Mr. Dwyer). The case for the Crown was that a neighbor of the accused, named Mrs. Spourse, hearing the sound of a child crying, went into accused's! house, and found she had given birth to a child, She advised that a nurse be sent for, but ac cused, .who was a widow, said she did not wish | her relatives to know of the occurrence. On November 27 Constable Power found the dead body of a child in Victoria Park, To the police accused admitted the birth of the child, but said she fell with it in her arms and killed it, and that she subsequently laid the body in the Domain. The medical evidence was that the child died from asphyxia, but there were no signs of violence on the body. Accused gave evidence on her own behalf, and denied the crime. The jury found the accused not guilty of mur der, but guilty of concealment of birth. A sentence of two months' imprisonment in Darlinghurst Gaol, with light labor, was passed, . but suspended under, the operations of the First Offenders Act.
