2. ↑ Source: #S7 Case Settled CASE SETTLEDA settlement in connection with the action for accounts brought by Horace Charles Tonka against the trustees in the estate of the late Enoch Tonks was announced by Mr. H. F. Johnston, counsel for defendants, when tho Supreme Court sat to-day. The terms ot the settlement, ias stated by counsel, were: (1) That the allegations of breach of trust be withdrawn; (2) that the action be dismissed; (3) that the defendants tavi their taxed costs as between solicitor and client paid out of the trust estate; and (4) that the plaintiff pay hisiown costs and the accountant's charge in connection with the report ordeied by; tho Court in May, 1929. Tho Chief Justice (Sir Michael Myers) said he thought the parties had been properly advised to come- to the settlement, which1 ho considered was a fair one and honourable to both sides. Mr. A. M.
