Edward was born in 1880. He was the son of Agnes and Michael Travers [1] He married Bertha Elizabeth Vincent in 1910 [2]
EQUITY OF A WILL. CLAIM FOR CONSIDERATION. A claim for an order under the Family Protection Act, 1908, was made concerning the will of the late Michael Travers, farmer, Kakaramea. the plaintiffs were the widow of the testator (Agnes Travers) and three of the children (Edward Travers, of Nukumaru, Mary Ann Dwyer, of Hurleyville, and Margaret Handley, of Wanganui). The defendants were Patrick Travers, youngest son of the testator, and Wm. Large, of Kakaramea, the executor. Mr. P. O’Dea (Hawera) appeared for the plaintiffs, and Mr. C. Hutton (Wanganui), instructed by Messrs. Hammll and Here (Patea) for the defendants. The plaintiffs claimed that insufficient provision had been made for them under a will dated November 29, 19I7, in which the widow was left £2OO a year for life and the use of 15 acres of land, without stock; £5OO was left to the daughter, Mrs. Handley; £26 to the eldest son, Edward; £IOO and £5O to two grand-daughters; and all the rest of the property to the youngest son, Patrick. The plaintiffs produced valuations to show that the value of the estate was about £13,000. After the life interest of the widow in the 15 acres terminated, the life interest parsed to the daughter, Mrs. Dwyer. The widow was blind and required a person constantly in attendance. A former will, dated February 25, 1904, had provided a life interest in a farm at Whenuakura for the widow, together with furniture, plate, linen, etc., and she was to have an income of £l3O a year, while the balance was to be divided among all the children in equal shares. It was stated that plaintiffs had no idea why any alteration had been made in this equitable distribution and that after making the second will the testator expressed dissatisfaction with the disposiion it made and determination to alter it. He died suddenly from influenza. It was asserted that the wealth acquired by the testator had been greatly contributed to by the labour of all his children.
His Honour said he did not think any of the plaintiffs other than Mrs. Dwyer was entitled to consideration as they were in good positions and the Family Protection Act did not give him power to alter the provisions of a will except in the case of those who were in poor circumstances. He suggested that Mrs. Dwyer should receive £5OO out of the estate, less the value of her reversionary interest in the small leasehold, Further hearing of the petition was adjourned to Wanganui. [3]
