Box 17, File 30; Last Will and Testament, Richard Truax
In the name of God Amen I Richard Truax of the county of Knox and state of Ohio being weak in body, but of sound and perfect mind and memory Blessed Be almighty God or the same you make and publish this my last will and testament in manner and form following what is to say, first I give and bequeath unto my he loved wife Mary Truex one mare, one cow, and five sheep, And as much household furniture as he pleases to keep, secondly I give and bequeath unto my son Nathaniel Truax, all my real estate by his pain the valuation of two thousand dollars, which two thousand dollars, after the decease of my wife is to be equally divided amongst my heirs, namely Tabitha Workman, Charity Seal, Rutha Francis, Elizabeth Nelons, Mary Melot and Nathaniel Truax.
I also direct that my wife Mary Truax receive one third of all my real and personal estate, during her lifetime, and to live with my son Nathaniel Truax, the said Nathaniel to keep for her use one mare, one cow, and five head of sheep free of any expense. And in case she should choose to live any where else, then my son Nathaniel to pay her thirty dollars yearly as long as she lives.
I likewise except one half acre of land for the purpose of a burying place on the North line of my Quarter Section, where there is one person buried opposite a sugar tree Marked.
I also direct that after the death of my Wife, my personal property to be sold for money, and the money that is on hand if any there by shall be equally divided amongst my heirs (namely) Tabitha Workman, Charity Seal, Rutha Francis, Elizabeth Nelons, Mary Melot and Nathaniel Truax, and lastly I appoint my beloved son Nathaniel Truax and my trusty friend John Truax, sole executors of this my Last Will and Testament; Hereby revoking all former wills by me made, In witness whereof , I have here unto set my hand and seal, this eighth day of December Anno Domini eighteen hundred and thirty five.
