He died in 1880 in New Castle, NY.[2][3][4]
Samuel left his wearing apparel and household furniture to his wife, Mary F. Tryon. He held a large number of bonds and stocks (mostly railways, some gold), many of which he left in a trust held by his executors, any income and dividends to be paid twice yearly to his wife, Mary F. Tryon. After Mary's death, the stocks and shares were to be divided equally between Smith Cox and James Cox, the sons, and William Cox, the grandson, of Samuel's deceased sister Mary Ann Poillon; Elisha, Robert and Emmeline Tryon, the children of Samuel's brother Smith Tryon; the sons of his sister Lucinda Dougherty; and John Tryon the son of his brother John Tryon.
Some specified bonds and shares were held in trust and the interest and dividends to be paid twice-yearly for her natural life to his niece Mary Louisa Whitlock, daughter of Lucinda Dougherty, and when Mary Louisa died to be divided equally between Smith, George and William Cox.
He left cash bequests to his friend and business partner Anton Miller (or, at Anton's death, to his children).
Samuel also left bequests to his nieces and nephews Nicholas Morris, Henry Morris, George Morris, John Morris, Caroline Brundage, Emma Horton and Mary Jane Smith, the children of his deceased sister Elmira Morris.
He also left specified stocks and bonds to be held by his executors in trust to pay the dividends and interest half-yearly to his nephew, Samuel Dougherty, and upon his death to pay the income for the support and education of the child or children of said Samuel Doughtery until the youngest shall arrive at the age of 21 years, at which time the stocks and bonds should pass to the child or children absolutely. If Samuel died without any surviving children, then his share was to be divided betweern his brothers and sisters, share and share alike.
Any residue of his estate Samuel left to his two brothers Smith and John Tryon and sister Lucinda Dougherty, share and share alike.
His real estate he wished turned into cash and invested in "first class" securities in lieu of any bond.
He named as his executors Washington A. Hall, Anton Miller (a business partner) and Charles E. Goodhue, whom he names as friends.[5]
He may have had an earlier marriage. The 1880 census has him living with "daughter" Mary F. Tryon. In the 1900 census she is living with a sister, Sarah Granger. However, in his will Samuel names Mary F. Tryon as his wife; she would be his second wife, his first wife and daughter having pre-deceased him.
