Actual Text August Court 1841, State of Carolina I EDMUND [Edward? the handwriting is unreadable] Waldrope Sen. of the County of Rutherford and state aforesaid anticipateing the certainty of death and the uncertainty of the time when that dispensation of providence may happen being disirous to execute my will with proper discretion and where in Possession of my usual mental facalties do make and delare this to be my last will and testament as follows: In the first place it is my will and desire that my present wife Mary Ann Waldrope shall remain here at my mansion house wherein I now live under the care and charge of my son Asberry so long as she lives single or dies & is to have a reasonable maintenance by and through her own means and exertion together with the aid and assisstance of said Asberry Waldrope and that I, Edmund Waldrope do allow my wife Ann to have the entire use and controle of the following pieces of property to wit: a certain note of hand due from Jechnius Waldrop to said Ann of one hundred seventy dollars and the interest two cows and calves two feather beds and furniture and the cuvard and such of the cuvard ware as can be best justified all of which I wish to remain hers for safe keeping at her oversite & pleasure. In the second place it is my will to bequeath to my son Asberry Waldrop the plantation and mansion house whereon I now reside containing 129 acres of land more or less. Beginning on a red oak on the north Bank of Green River and running a North Course 50 East 20 poles keeping with the Buts and Bounds according to the conveyance made from Richard LEWIS to me on the dividing line between myself and Aaron FOWLER, and then with said line to the River & from thence meandering with the River & to the beginning to have and to hold during his natural life also is to have all my horse, cattle, hogs, household and kitchen furniture & _____ Farming tools of every kind also all my Outstanding debts of every kind & it is further my will & desire that if my son Asberry should die before he should marry, that all the property and land bequeathed by me to him be equally divided amongst the surviving heirs and Children of my body. In the 3rd place I will & bequeath to my several children namly as follows: Catherine Thompson, Alford Waldrop, Davidson Waldrop, Jonathan Waldrop, Sarah Splawn Caswell Waldrop, Priscilla Owens, Levina Woods, Edmund P. Waldrop and Jane Waldrop, each to have out of my Estate one dollar apiece to be paid after my death by the Executor. It is my desire that my wife Ann Waldrop & son Asberry Waldrope act as executor and Executrix to this my last will and testament disquallifying all others.
