4. Will - Luke Waldrop 1854, Will Book? page 260?, March Probate Court, 1854. "North Carolina, Rutherford County. Jan the 12th 1854. I Luke Waldrope being old and infirm but of sound mind and memory, but calling to mind that I must die, do constitute this to be my last will and testament, first of all I commend my soul to God who gave it and that my body be decently buried and that all my just debts be paid and as to what little property it has been pleasing to God to give me I shall dispose of in the following manner to wit, I have already given my sons Samuel and Mercer R. each a poney which I valued at forty dollars, and a bed and some other things to the amount of fifty dollars, I have also give my son Joseph C a poney at the same price forty dollars & I give him a feather bed and furniture to make him equal with the first named two. And my daughters Patsy and Jane I have given to each a bed and furniture and some castings etc. and Jane has had one bee hive, and I also I give one to Patsy Almura, and I give to my two daughters Harriet A & Rebecca each a feather bed and furniture and bee hive each and some pot ware and shelf ware to be equal with Patsy & Jane and the balance of property, horses, cattle, hogs and sheep & fowl and all my corn fodder oats and wheat, my household & kitchen furniture together my land, one hundred & forty acres more or less with all its appertenances I give to my well beloved wife Sarah her lifetime or during her widowhood with the privilige of Amanda, Rebecca and Joseph living with her, and at the death of my wife all the perishable property to be sold to the highest bidder on a twelve months credit and divided in the following manner. If John Cud shall stay until he is twenty one years old, he shall have two suits of clothes and ten dollars, and the ballance divided equally between my sons Terrill F., Mercer R & Samuel Mc, Joseph C, and my four daughters Patsy A, Harriet A. & Jane and Rebecca after my lawful Executors takes their lawful fees out for their services. And my land I leave to my son Joseph by his payig my son Terrill fifty five dollars, as I have never gave him anything, and want him to be equal with my other sons by Joseph staying and waiting on his Father and Mother in their old days, and also with the privilege of Mandy & Rebecca having the chance of staying on the place while single as their home. And I leave James Jackson my son-in-law and Joseph C. Waldrop my Executors to this my will, interlined before assigned I appoint Jas Jackson and my son Joseph my executors. Luke Waldrope
