This indenture made this 1st day of November in the year of our Lord 1841 between David Webb of the first part, and Alexander Enis Trustee of the second part, and David P. Fowler and Samuel Waldrop of the third part: Whereas said Webb is justly indebted to Turner Saunders one hundred and forty two dollars to be paid 1st January 1842 and said Fowler and Waldrop are his securities the note dated January 1, 1841, and also note to Ephraim Shuffield dated Jany. 1st 1841 due Jany. 1s 18?? for sixty six dollars and forty six cents and D. P. Fowler and John Riggs securities to it, which debts said Webb is willing and desirous to secure, Witnesseth that for and in consideraion of the promises, and also for the further consideration of one dollar to the said Webb in hand paid by the said Enis at and by the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, he the said Webb hath given, granted, bargained, sold and conveyed unto the said Enis, one Stallion called Bustow, one bay gelding horse, one sorrel mare, three cows & calves, and three beds bedsteads and furniture, one press, one clock, and other household and kitchen furniture, and all the ??? and interest of the said D. Webb in and to the said granted or intended to be granted premises to have and to hold the aforesaid property hereby conveyed unto the said Enis his heirs and assigns forever to the only proper use and behoof of said Enis &C forever--and the said Webb for himself, his heirs, administrators doth hereby covenant promise and agree to and with the said Enis &C in manner and form following that is to say, that the said Enis, his heirs, executors and administrators the aforesaid personal property hereby conveyed to the said Enis, his heirs, administrators &C. against all persons whatsoever, will warrant and forever defend by these presents, upon trust, nevertheless that the said Enis his heirs, assigns, shall permit the said Webb to remain in peaceable possession of the said property hereby conveyed and take the profits thereof to his own use until the 10th day of February 1843; then if said Fowler and Waldrop or either of them should have any part of the above debts, or the whole of them to pay & and there upon this further trust that said Enis or his administrators, or assigns shall, and will so soon after the happening of such default of payment, as he or his administrators or assings may think proper, or the said Fowler and Waldrop or either of them or their administrators or assigns shall request, sell the said property hereby conveyed or such part of it as the trustee or his representative hereby authorized to act, shall think sufficient for the purpose and shall think proper, to sell to the highest bidder for cash at public auction, after having fixed the time and place of sale, and given twenty days notice by putting up two or more advertisements at public places in said county, and out of the money arising from such sale, shall after satisfying the charges thereof, and all other expenses attending the premises pay to the said Fowler and Waldrop or their heirs, all they or either of them may have to pay by being said Webbs security as aforesaid. But if the whole of the said sum or sums as above described shall be fully paid off and discharged--then this indenture to be void, or eles to remain in full force and virtue in witness whereof the said parties to these presents have hereunto set their hans and affixed their seals the day and year above written. The State of Alabama, Lawrence county. this day came before me David Webb, Alexander Enis, Daniel Fowler and Samuel Waldrop and acknowledged that they severally assigned the deed hereto annexed for the purpose therein contained--Given under my hand and seal this 1st day of November 1841. Harmon Waldrop, J.P., Seal.
The State of Alabama, Lawrence county. I Wiley Gallaway Clerk of the County Court of said County certify that the foregoing deed was deposited in my office for registration on the 4th day of November 1841 and was this day duly recorded in Deed Book K. pages 12 & 13. 1844 --- Lawrence Co., AL. Orphan's Court Minutes. October Term. Martin & Waldrop Admr. Estate John Truhit Deceased vs Decree for Little. The heirs of said decedent. On the applicaton of William H. Martin one of the administrators of the estate of said decedent and it appearing to the satisfaction of the court that final payment has been made for the following described land sold by Samuel Waldrop and James Gibson Commissioners appointed by the Honorable Orphan's Court at the December Term 184?. To John H. Harris and Slas M. Fowler to wit. To John H. Harris the North West quarter of Section 2 Township 4 Range 8 West and all that part of the North East quarter of Section 2 Township 4 Range 8 West which lies on the west side of Big Nance Creek all in Township 3, Range 8 containing 283 acres and to Silas M. fowler, the Northeast 1/4 of Section 3, Township 4, Range 8 West. It is ordered by the Court that said Commissioners make such title to the said above described to the said John H. Harris and Silas M. Fowler. (to the lands purchased by each respectively) as was vested in said decedent at the time of his death.

Deed in Trust. James W. Henderson to Samuel Waldrop. 30 Oct 1854. State of Mississippi. Pontotoc County. Whereas James W. Henderson is justly indebted to John Price and Simeon Freeman in the sum of Seventy six & 11/100 dollars bearing eight percent interest per annum from dte of this instrument the true and punctual payment of which the said James Henderson is desirous to secure. Know all men by these presents that I J. W. Henderson in consideration of the above debt do bargain and sell to Samuel Waldrop Trustee my entire stock of cattle consisting of thirteen head to wit. oen black cow with a white face & speckeled cow marked with crop of the right and split in the left one red cow white faced & back crop of the right & under sloap in the left and one cow marked with under sloap & half crop one black cow marked with two under sloaps one three year old bridle steer marked under sloap in each ear four yearlings 1 dare two blacks one black & white pided 3 steers year old post marked under sloap in each year three last spring calfs heifers 1 Brindle & white & black & red & white marked with under sloap in each year. To have forever upon trust never the less for the following purpose to wit if the said J. W. Henderson shall fail or neglect to pay or refuse to pay the debts above described when it becomes due then the said S. Waldrop trustee shall and may at any time thereafter at the request of the said J. Price and S. Freeman proceed to sell the above described cattle to the highest bidder for cash at any convenient place after giving ten days notice of the time and place of sale and with the money arising from said sale the said S. Waldrop trustee shall first pay the debts described with the interest & expense arising upon this instrument the balance if any of the money he shall pay over to the said J. W. Henderson but should the said J. W. Henderson pay and satisfy said above described debt together with all legal fees & expenses before any such sale then this obligation shall be void and the said S. Waldrop trustee shall release the above described cattle from this trust the said J. W. Henderson to keep possession of said property until default. In testimony whereof the parties have hereunto set thier hands & seals the day and date above written. The said deed above described is to fall due the first day of January A.D. 1856. J. W. State of Mississippi. Pontotoc County. Personally appeared before me M. D. Vance an acting Justice of the Peace in and for said county J. W. Henderson who acknowledged that he signed sealed and delivered the foregoing deed and executed the above note to the within named parties as his own act & deed on the day and date therein mentioned. Given under my hand & seal April 14th 1855. M. D. Vance. Justice of the Peace.

State of Mississippi. Pontotoc County. Whereas James W. Henderson is justly indebted to John Price Eighteen dollars with ten per cent interest by note bearing date with this instant the true and punctual payment of which the said J. W. Henderson is desierous to secure Therefore Know all men by these presents that I James W. Henderson in consideration of the above debt do sell and convey to Samuel Waldrop upon trust one Black or dark bay horse and my entire crop of Corn & Cotton to be raised next year to have and to hold upon trust nevertheless for the following use and purpose to wit that if the said J. W. Henderson fail or neglect to paythe above debt when it becomes due then the said S. Waldrop trustee shall and may at any time thereafter at the request of the said J. Price proceed to sell the above described horse & crops for cash after giving thirty days notice by advertising at three public places in the district and with the money arising arising from said sale the said S. Waldrop trustee shall first pay all fees & expenses arising attio'g? this trust, next to pay said debt principal with interest above described the balance of money arising if any from the sale he shall pay to the said J. W. Henderson but should J. W. Henderson pay the above debt with all fees, when it becomes due or before sale then this obligation to be void otherwise this trust to be in full force of virtue. 1855 --- Pontotoc Co., MS. Deed Book 10, Page 541. Samuel Waldrop to James Edens of Chickasaw Co., MS. North 1/2 of SW 1/4, Section 29, Township 11, Range 5E. 80 acres for $325.00.

Know all men by these presents that I Samuel Waldrop of the State of Mississippi County of Pontotoc for and in consideration of the sum of three hundred & twenty follars to me in hand paid by James I. Edens of the County of Chickasaw & State above named have this day bargained & sold & by these presents do bargain & sell unto the said Edens the following described parcel of land lying and being in the County of Pontotoc and State of Mississippi & more particular described as the North 1/2 half of the South West 1/4 quarter of Section 29 Twenty nine Township 11 eleven Range 5 Five East containing 80 eighty acres more or less to have and to hold unto the said James A. Eadens and I do further warrant & defend the title of said land to the said Edens from the claim of every & all persons claiming said land by or through me. In testimony whereof I hereunto put my hand & seal January 26, 1855. Samuel Waldrop, Seal. State of Mississippi. Pontotoc County. Know all men these presents that I Mary R. Waldrop wife of Samuel Waldrop whose name is affixed to the within Deed of Conveyance do hereby relinquish my right of dower to the said described land. State of Mississippi. Pontotoc County. This day before me a justice of the Peace for & in said county personally appeared Mary R. Waldrop wife of Samuel Waldrop whose name is affixed to the above relinquishment of Dower & on a private examination seperate & apart from her said husband acknowledged that she signed sealed & delivered the same as her voluntary act and deed freely without the fear threats or compulsion of her said husband. Given under my hand seal of office. John Tallant, Seal. Justice of the Peace.
State of Mississippi. Pontotoc County. This day before me Drury J. Pitts Clerk of the Probate Court of said county personally appeared the above named Samuel Waldrop who acknowledged that he signed sealed & delivered the above deed as his voluntary act and deed for the purpose therein set forth upon the day & year threin mentioned. Given under my hand & seal of said Court at office the 17th day April 1855. D. J. Pitts, Clerk.

State of Mississippi. County of Pontotoc. In consideration of the sum of thirty two hundred dollars the receipt whereof is hereby acknowledged I Samuel Walrop of Pontotoc County Mississippi do grant bargain sell and convey to William W. Prady the following land known and described as the East half of Section thirty five Township Eleven Range five East of the basis meridian according to the plan of the survey of Chickasaw Cession Mississippi except sixty acres on the west side of the southeast quarter of said section. To have and to hold forever in fee simple. The said Samuel Waldrop hereby covenants that he is siezed and possessed of said land and will warrant and forever defend the title to the said William W. Prady his heirs and assigns against the claims of all persons whatsoever. In witness whereof the said Samuel Waldrop has hereunto set his hand and seal this the 28th day of May A.D. 1859. State of Mississippi. Pontotoc County. Personally appeared before me C. J. Jones Clerk of the Probate Court in and for said county the within named Samuel Waldrop who acknowledged that he signed sealed and delivered the within deed as his own act and deed on the day and year therein mentioned for the purpose therein set fourth. Given under my hand and seal the said court at office this the 26th day of May A.D. 1859. C. J. Jones, Clerk.

Richey of the County of Lafayette and State of Mississippi of the first part and Samuel Waldrope of the second part Witensseth that the said T. J. & J. W. richey for and in consideration of the sum of four hundred to them in hand paid the receipt whereof is hereby acknowledged hath bargained and sold and by these presents doth bargain sell deed and convey unto the said Samuel Waldrope the South West quarter of Section four (4) Township eleven (11) of Range one (1) East of the basis meridian in the Chickasaw Cession to have and to hold the aforesaid land and bargained premises with the appurtenances in fee simple to the only proper use and behoof, of the said Samuel Waldrope his heirs and assigns against the claim of all claimants whatsoever, in witness whereof the said T. 1871 --- Pontotoc Co., MS. Gravestone has Mason Insigna says Born 15 Apl 1804, Died 3 May 1871. Loved in Life, in death not divided. Max Waldrop and his father found the stone broken in 4 pieces in the winter of 2005. They repaired it. [Photo of stone in file.-CW]

To the Hon. A. B. Fly Chancellor of the 2nd Chancery District &C The petition of the undersigned Administratrix of the Estate of Saml Waldrop dec'd would respectfully show that she has her final account as said Administratrix. That she has collected & charged herself with all debts collectable and those not collected are unsolvencies & worthless. That she has paid the entire indebtedness of the Estate & reported the same in her accounts with her vouchers. The amt collected is $1224.23 upon which she claims 7 per cent & asks the court to allow it.
Petitioner further shows that she is the widow of said decedent & that she has no children, and as such is entitled to one half of said estate after the payment of debts.
Petitioner further shows that said Saml Waldrop had one brother Harmon Waldrop, who resides now in Pontotoc County, and one sister who married Rufus Johnson & died leaving three children, Mary C., Sarah & Margaret. Mary C. married Andrew Rhodes, & she has since died leaving a number of children whose names she does not know, & who reside in Fannin county, Texas as she is informed & believes, but whose Post Office she does not know & can not ascertain but suppose it to be the County Seat. Sarah married Robert Anderson & Margaret married Wm. Dowdy & they are living in Shelby Co., TN. Their Post Office Buntin Station as she is informed & believes. That said parties are interested in what remains of said estate to the extent of one half of it. That there are a few parcels of land belonging to said estate whereupon she prays for an order to cite or summon Harmon Waldrop & publication in the Pontotoc Democrate a newspaper printed & published in the town of Pontotoc as the law requires in such cases for those residing out of the State to be and appear before the next term of the chancery court to be held on the 1st Monday of March next to show cause why said final account should not be allowed & your petitioner discharged as Admrx &c. Respectfully Submitted, Mary R. Waldrop, Admrx.

NON RESIDENT NOTICE. State of Mississippi, Pontotoc County. Chancery Court, In Vacation Jan. 20, 1880.
Mary R. Waldrop Admrx of Samuel W. Waldrop
Upon opening the papers in this cause and it appearing to the Satisfaction of the Court, from affidavit on file, that the following parties Interested in said Estate of Sam'l Waldrop Dec'd to wit: Andrew Rhodes, husband of Mary C. Rhodes Dec'd, and her children whose names are unknown, are non residents of the State of Mississippi, but reside in the State of Texas, and Fannin County, Post office not known, and Sarah Anderson and her husband Robt. Anderson, and Margaret Dowdy and her husband Wm. Dowdy, are also non residents of the State of Mississippi, but reside in the State of Tennessee, Shelby County and that thier post office is Buntin Station in said State. It is therefore ordered by the Court, that the above named non residents appear at the next term of the Chancery Court of Pontotoc County, Mississippi, to be held at the Court-house thereof on the 1st Monday of March 1880, and show cause if any they can why said final account shall not be allowed as stated and filed, or the same will be taken for confessed as to them. It is further ordered that a copy of this order be published in the Pontotoc DEMOCRAT, a public newspaper printed and published in the town of Pontotoc once a week, for four consecutive weeks, before the session of said Court, and that the Clerk of the court transmit by mail postage paid a copy of this order addressed to each one of said parties at their said post office.

This day this cause came on to be heard on final acct., Judgemet pro confesso, Exhibits & Proofs - And it appearing to the satisfaction of the Court that said account is properly stated, supported by proper and legal vouchers, and in nothing excepted to. It is therefore considered by the Court that said account be allowed as stated, and that said Administratrix be allowed commissions as charged in said account at 7%. And it further appearing to the satisfaction of the Court that there remains in the hands of said Administratrix subject to division and distribution the sum of Eleven and 27/100 Dollars, of which sum said Administratrix is entitled to the sum of five dollars and sixty three cents, Harmon Waldrop is entitled to the sum of Two and 81/100 Dollars, the heirs of Mary C. Rhodes are entitled to the sum of ninety three cents, Sarah Anderson is entitled to the sum of ninety three cents and Margaret Dowdy is entitled to the sum of ninety three cents.
And it is further ordered adjudged and decreed that said Administratrix make such division and distribution of the said amt. as herein indicated.
