Confusion and Conclusion

Confusion:
According to the family tree published by Mr. Marlyn Lewis, Helen Waryn/Warren and Ellen Waller/Waler are not the same person, and they married two different men called John Foote, one the father of the other. Mr. Lewis references 'Brent Ruesch's Research Notes. "Ellen Waller married John Foote, son of John Foote and Helen Warren, in 1550."[1]
According to Myrtle Stevens Hyde in TAG Vol 58 page 165, the will of "Richard Warrene, otherwysse called Waller, of Bassingborne, county Cambridge [dated 28 March 1557, proved 2 May 1557, Archdeaconry of Ely]" and the will of his son Richard Warren [brother of Helen Warren] prove that Helen Warren is the same person as Helen Waller and she married John Foote. [2] Her spouse is John Foote of Royston, born 1530.
Conclusion:
A Will as proof of a relationship/identity is the acceptable evidence for making a conclusion regarding what is a correct relationship. In the first paragraph, research notes by Brent Ruesch are cited as the source, but we have no way of accessing the notes or knowing what evidence Brent Ruesch used in his research.
In the second paragraph, we have wills cited, which can be found in public records, and which makes the relationships and identity of Helen Waller/Warren crystal clear. There is no alternative but to accept the evidence of the will as the final proof of identity and relationship for Helen Waller/Warren, while noting the origin of alternative trees, which cannot be correct in light of the will. Helen (Warren) Hall was born in England.

Helen Warren was daughter of Richard Warren and his wife Alice and sister to a brother also named Richard Warren, probably born in Bassingborn, Cambridgeshire, England, about 1529.[2]

"Helen Warren or Waller married John Foote[2] and they had the following children:

  • Alice 1549
  • Aves 1553
  • Robert 1553
  • Elizabeth 1556
  • John 1558[2][3]

Helen/Ellen Waryn (or Warren), widow of John Foote, married Sgt. Trumpeter John Haull on 19 Jan. 1558/9 at St. Peter Cornhill in London, England.[4] Sgt. Hall or Haull served as a court trumpeter in the court of Queen Elizabeth I. [4]

Notes

Note: Robert Foote is disproved[4] as the husband of Helen Waryn [or of Helen Waller/Waler] and the father of Robert Foote who married Joane Brooke[4] and his brother John Foote who married Joane's sister Margaret Brooke.[3] The father of John and Robert Foote is proven to be John Foote, tallow chandler, by his will.[4]
Note: Death date of 18 July 1558 for Helen is an error. 18 July 1558 is the date before which Helen's husband John Foote died. Helen's death date is unknown, but she was very much alive after her husband's death, as documented by the record of her second marriage to sergeant trumpeter John Hall in St Peter Cornhill in London on 19 Jan 1559. Jillian, I agree, we need the text of the will(s), from a reliable source. I have an NEHGS membership & have been planning a trip to their library, where they have the TAG articles -- if I don't find copies closer to home; looks like Waltham, MA has a bunch of years. AND I can drop my overdue library books at Waltham.

Whoa, just realized the TAG articles are online after all, thanks to a link in the sources at Robert Foote's profile, probably by April Dauenhauer -- have a look at her notes about the work she's done. (And no thanks to the NEHGS search engine, which had refused to give me anything but the index to date...)

[4] WARREN-194 should be the final ID#, because Waller (spelled with 2 "l"s) is an alias of her father Richard Warren.
The husband of Helen Warren aka Waller is John Foote SENIOR born 1530, John Foote.
Foote-8 and Foote-194 should not be merged because the documented husband for Foote-194 is John Foote. There are trees which show her husband erroneously as Robert Foote. If the husband Robert is removed and replaced with John Foote, the can proceed.

I still think they are the same person, but should not be merged until the husband is corrected.

Warren-4020 and Warren-194 appear to represent the same person because: Helen Warren-4020 and -194 were both born in Cambridge in 1527 and died in July 1558. There is very little info on Warren-4020.
