Son of Allen Warren III and Mary Phillips Warren. (Not Jesse, son of Hinchey Warren)

Served in Revolutionary War, Commissioned a Lieutenant in Captain Wilson's Company of Surry County Militia

Court Case land dispute

“To the worshipful court of Surry in Chancery setting Humbly complaining show unto your worship your complainants Jesse P. Warren, Samuel Warren and his wife Martha, Thomas Pointer Gwaltney and his wife Elizabeth late Elizabeth Warren, That Jesse Warren late of this county departed this life several years past intestate and seized and possessed of a tract of land lying and being within the county aforesaid – that at the time of his death, he left a widow called Martha who has since intermarried with a certain Benj. Bell. That he left your complainants Jesse P. Warren, Martha wife of Samuel Warren, and Elizabeth wife of Thomas Gwaltney, and Rebecca wife of a certain James P. Bell and Avarilla an infant whose __ years is the said Ben Bell and Edwin Warren his children. That since the death of the said Jesse Warren, Rebecca the wife of James P. Bell hath also died leaving an only daughter called Nancy who is now an infant of tender years. That subsequent to the death of the said Rebecca, Edwin Warren another of the children of Jesse Warren as aforementioned hath departed this life under the age of twenty one years without issue. That before or after the intermarriage of the said Martha widow of the said Jesse Warren decd with the said Benjm. Bell the dower of the said Martha was laid off by proper metes and bounds and legally assigned in the land aforementioned. That the balance of said land amounting to 419 acres remains undivided to the manifest ___ of your complainants as well as to all others entitled. From the statement of the foregoing facts it will appear that at the time of the death of the said Jesse Warren, your complainants Jesse P. Warren, Martha the wife of Samuel Warren and Elizabeth the wife of Thos. Gwaltney and the before named Rebecca decd wife of James P. Bell, Avarilla and Edwin Warren were equally entitled to the remainder of the land after the assignment of the dower to the widow. That be the death of Rebecca wife of James P Bell, Nancy Bell the only child of the said Rebecca became entitled to her mother’s portion and that by the death of Edwin Warren who was brother of the whole blood to all the aforementioned children of the said Jesse Warren, they have all with the said Nancy Bell the child of the said Rebecca Bell decd. become equally entitled to that portion which aforesaid belonged to the said Edwin Warren decd. and

In tender consideration whereof and in as much as your complainants are ___ in the ___ in a court of Equity where matters of this kind are properly and alone coguizable __ may that the said Benja. Bell and Martha his wife the said Avarilla Warren by her guardian the said Ben Bell, and the said Nancy Bell the infant child of Rebecca wife of James P Bell by her father the said James P Bell may be made defendants hereto and be compelled to answer all and six years the allegations herein contained awfully and unevessively, as if the same where here again ___ and they think particularly interrogated and they further pray that your worship would adjudge and decree the land aforesaid and be we the same of the dower of the said Martha what hath been already assigned to be divided between and among the complts. And defend unto the following in mossertions court one fifth part to your complainant Jess P. Warren, 1 – 5th to your complainant Samuel Warren and his wife Martha in right of his said wife. 1 – 5th to Tho. Gwaltney and his wife Elizabeth in right of his said wife. 1 – 5th to the deft. Nancy Bell an infant daughter of Rebecca Bell dec’d. 1 – 5th to Avarilla Warren and make report to this court in order to a final decree.

And your complainants further pray that your ___ would make such and further order a decree in the promises ___ be current with justice and equity and they will be.
