Text: This is a transcription from the original will of James Wells: Surry Co., NC Wills, Vol. 3, Page 96, 25 Jan 1810 Page 96 In the name of God Amen. I James Wells of the County of Surry and State of North Carolina being very sick and weak or in perfect health of perfect mind and memory thanks be given unto God calling unto mind the mortality of my body and knowing that it is appointed fro all men once to die do make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul into the hand of the Almighty God that gave it and my body I recommend to the earth to be buried in a decent christian burial manner at the discretion of my Executors nothing doubting but at the general Resurection I shall recieve the same again by the mighty Power of God and as touching worldly Estate wherewith it has pleased God to bless me in this life I give demise and dispose of the same in this following manner and form First I give unto my beloved son Thomas Wells twelve shillings and six pence. And unto my daughter Elizabeth Riece twelve shillings and six pence. And unto my daughter Lucretia Witty twelve shillings and six pence. To my son Nenam Wells twelve shillings and six pence. To my daughter Racheal Hutchens twelve shillings and six pence. And my daughter Susanna Rash twelve shillings and six pence. And my son John Wells twelve shillings and six pence. And Marian Wells twelve shillings and six pence. And my daughter Mary Beck twelve shillings and six pence. And to my son James Wells all my land and tenements and also one half of my moveable property & the other half of my moveable property to be left to my beloved wife Mary Wells. and as I consider the property she has brought to me when we were married is her own I want her to hold the same without any division. So this being confirmed as my last will and testament. In witness whereof I have hereunto set my hand and seal this 25th day of January in the year of our Lord 1810. And Signed and sealed and declared in the presents of each other who have here unto subscribed our names James / Wells mark Test John Brinkley Solomon Jones State of North Carolina Surry County November Session AD 1810 John Binkley (one of the subscribing to the foregoing last will and testament of James Wells) made oath that he saw the said Wells sign publish and declare the same to be his last will and testament that he was of sound and disposing mind and memory and at the same time he saw Solomon Jones sign the same as a witness thereto which was ordered to be recorded. Recorded according by ?? Jo Williams CC Sons : Thomas, John and Nunam. my daus; Elizabeth Riece, Lucrettia Witty, Rachel Hutchens, Susanna Rash, Marian Wells, Mary Beck. Son James to have the land. wife Mary to have the land she bougth with her when we married. No exrs. Wit: John Binkley; Solomon Jones. Proved by Binkley.. Rec Nov CT 1810. Note SurryCo. 1782 tax list shows him with 250 A on Lick Creek.
