Joshua died August 30, 1757, Worcester County Probate, has administration upon estate of Joshua Winchester of Grafton 1757. [1] His widow Mary, noting her inability to travel to the courts, asked that her father James Whipple be appointed estate administrator which was granted in September, 1757. The court appointed a committee to complete the estate inventory. Joshua's real estate was valued at L122: 13: 4 and his personal estate at L69: 18: 7. A further accounting of debts due was also submitted. [4]
Prior to the completion of an estate settlement, administrator James Whipple Sr. died and son James took over the administration. After submitting an accounting of debts paid, widow's allowance and various costs, there remained L44: 17: 9. On November 13, 1759, the court ordered that sum was to be paid to the guardians of the children at the time of the widow's decease. [4]
In his will dated December 25, 1758, Benjamin Winchester left L4 a piece to the heirs of his son Joshua, being his daughters - Mary, Sarah and Prudence Winchester. [5]
His widow Mary married second Ephraim Sherman Jr. of Grafton [3] on May 12, 1760. [2]
In the settlement of her father James Whipple estate, Mary Winchester, along with her siblings acknowledged their acceptance of his will as submitted to the courts for proving. As his lands could not be divided without prejudice, the sons inherited lands while Mary Winchester and her sister Sarah Willard were each granted L156: 18: 6 in old tenor as their share, with sister Eunice to be paid by her brothers. [6]
On May 20, 1760, Mary and Ephraim Sherman, as heirs of James Whipple acknowledged receipt of their share of the personal estate and movables from her brother James, estate administrator. [6]
On March 30, 1758. Mary Winchester, James Whipple Jr. and Jacob Whipple posted bond in the appointment of Mary Winchester as guardian to her daughter Mary, aged almost seven years [7] her daughter Sarah [8] and her daughter Prudence aged above three years. [9]
On July 3, 1758, Mary Winchester submitted to the court a petition to be freed from guardianship of her children - Mary, Sarah and Prudence and requested that her father James Whipple be appointed. [7]
In the same month, July, 1758, James Whipple was appointed guardian to Mary Winchester, Sarah Winchester then almost 5 years old, and to Prudence Winchester aged three, daughters of Joshua Winchester, deceased. [7][8][9]
On October 24, 1759, Mary Winchester was again appointed guardian to daughter Mary, aged eight in June past [7], daughter Sarah ged six years as of the previous August. [8] and daughter Prudence. [9] after the death of her father James Whipple, guardian to the children.
On May 10, 1763, Jacob Whipple was appointed guardian to Mary Winchester, to Sarah Winchester aged eight, and to Prudence Winchester aged six years, daughters of Joshua Winchester, deceased, Jacob along with both Ephraim Sherman Jr. and Sr. providing surety. [7][8][9]
