Biography

Estate of William Winchester began with Rachel, his widow vs. James R. Winchester,et al and was settled, giving all land to Rachel Winchester aka Mrs. Rachel Winchester, only. In 1857 Rachel died and the same J. R. Winchester again petitioned to obtain the property for himself and other kin who were listed in 1852.

Thee original petition was quickly written and difficult to understand with many cross-outs and corrections. It was cleaned up later. The final settlement for Rachel in 1852-3 was that she received all the property.

Your petitioner further sheweth that the above named defendants and the children and heirs-at-law of sd William Winchester and that they are all of age except the following heirs of Andrew WINCHESTER Dec'd to wit: William V, Joseph A., Rufus P., John Potter, Liza C ?Pertina and Nancy Ann and the following the heirs of THOMAS WINCHESTER, Deceased -- who are minors under the age of twenty ones years to wit: William, John, Allen, Permilia, Jane, Isabelle, & Rachel ?Henrietta and Jane McGuirt {NOTE hard to read - two Jane minors?)

Your petition further sheweth that all of the above infants reside in Union County in this state except William Winchester, Joseph Winchester, Joseph Winchester, Jason Winchester, Noah Winchester and John Winchester, the heirs of Andrew Winchester and the heirs of Thomas Winchester who reside beyond the limits of the state.

Your Petitioner therefor prays that your worships will order publication to made according law (sic) notifying said non residents to appear at the next term of this Court to show cause why the prayer of the petitioner shall not be granted and that your worships shall appoint some suitable and disinterested as guardian to defend the rights of the said infant heirs Wm. V., Joseph A. Ruphus P., John Potter, Liza C. Perlina, Nancy Ann, William, John, Allen, Permilia, Jane, Isabella, Rachel,, Henrietta, and Jane McGuirt in this suit and a writ of dower may issue to the Sheriff of said county commanding him to summon a jury of good and lawful men to lay off and a lot by metes and bounds to ____ petitioner, her Dower in thirds in the lands aforesaid and put her in possession of the same and that your worships will from time to time will be pleased to make such other and further ???? and ???? as to same and Justice may appertain.  ? ?
