He passed away in 1867. He is buried in the Thompson's Lake Rural Cemetery, East Berne, Albany County, New York, USA.[1]

Leaves to his beloved wife Susan; $50, a bed and bedding, stove and fixtures, six flag bottom chairs and one set of dishes. To his daughter, Malivina; $100 and the rest of the household furniture. To his youngest son Martin; $100. The rest of his money and property to be divided between his two sons William and John B.; also William gets an interest that was John B Winne's (Benjamin's Father). Henry Slingerland (brother-in-law) and his son John Slingerland are made exectutors. Signed 31 May 1867.[2]
