Hugh Evelyn Bt was born in Totnes, Devon, England.

5th Baronet Evelyn of Wotton
Sir Hugh Evelyn, 5th Baronet, who succeeded his brother as 5th Baronet in 1833, was born at Totnes, Devonshire, January 311 1769. He was the fourth son and youngest child of Charles Evelyn's family of nine children. Through the influence of Sir Frederick Evelyn he obtained a commission in the Bengal Navy, but in later life his mind became unsound.[1]

Birth
Hugh Evelyn was born in Totnes, Devonshire on 31 January 1769,[2] the youngest son of Charles Evelyn and Philippa Wright. He was baptised in Totnes, Devon on 20 June 1769. [3]

Schooling
The following is an extract from an account of the Last Male Descendants of John Evelyn by William Bray in 1831:
Sir Frederick took the youngest son Hugh to Wotton, and sent him to a very good school at Guildford. He very soon gave symptoms of what was likely to be his future conduct by running from school, as he also did from another school where Sir Frederick placed him.[1]

Controversy
The trustees in General William Evelyn's will were - Strode, Esquire, a gentleman of large fortune in Herts, and William Mann Godeschale, Esquire, a gentleman living upon a considerable family estate at Albury, in Surrey, where he took a very active part in all the public business of the county. Mr. Hugh Evelyn had a placard printed and posted up in different parts of the city of Westminster offering a reward for the apprehension of Mr. Strode and Mr. Godeschale on a charge of perjury and forgery. Mr. Strode thought this was too gross a business to be passed over without notice ; he therefore directed an indictment to be preferred against him for this libel. On hearing the cause, the Court sentenced Mr. Hugh Evelyn to pay a fine, the amount of which I forget, and that he should be imprisoned till that fine was paid, and till he had given proper security for his future behaviour. In April 1797 he was tried and held in the Newgate Prison owing a fine of £34 10s.[4] He was ordered to remain on commitment until discharged.[5]
On the 18 August he was transferred to the Kings Bench prison in Southwark.[6][7][8]

Again from the book "The History of the Evelyn Family" -

In this miserable situation he remained for some years ; but it is very extraordinary that in this situation the widow of an officer who had half-pay, by some means, became acquainted with him, giving him much assistance, and much good but useless advice.
In ... , Mr. Strode died, having survived Mr. Godeschale, when Mr. Hugh Evelyn applied to be discharged and obtained his discharge. The gentlewoman above mentioned absolutely married him. [1]

The "gentlewoman" mentioned is of course Hugh's second wife who he married in 1836. The timing of this comment is difficult to determine and depends on when Mr Strode died. An examination of General William's will shows that Mr Strode is William Strode presumably a descendant of the 17th Century Parliamentarian of the same name.

Sir Hugh appears in the 1814-1819 Roll of Jury-Qualified Freeholders and Copyholders with a lease on a property in Prospect Place, Southwark, St George, London.[9] A Land Tax Record for 1814 shows that he has tax to pay of £1 14s on the same property.[10]

Marriage
Hugh married Henrietta Harrisson on 9 December 1815 in St John the Evangelist, Smith Square, London, Westminster.[11]

Baronetage
In 1833 upon the death of his brother, John, Hugh succeeded to the Baronetage of Wotton. Unfortunately for Hugh this did not include the Wotton estates which his brother did not inherit.[12]

Sir Hugh's eccentric state of mind is reflected in a letter he wrote in January 1828 to the Coroner for Sussex, insisting that his sister Philippa had been murdered. Philippa, the wife of Wilbraham Liardet died in 1824.[13]

Death of First Wife
In July 1836 Henrietta Harrison, Sir Hugh's wife, aged 58, died and was buried in Southrepp, Norfolk.[14][15]

Second Marriage
Hugh married Mary Hathaway,daughter of John Kennedy and the widow of James Hathaway on 12 November 1836 in Saint Martin In The Fields, Westminster, London.[16]

Sir Hugh was again in trouble in 1839 with quite substantial outstanding debts as the reports in the London Gazette detailed.
Debtors Prison
In January 1839 the London Gazette reported on those in the "Court for Insolvent Debtors" with Sir Hugh being listed as "On Creditors Petitions" as Sir Hugh Evelyn, Bart. of Darlington Place, Borough Road, Southwark, Surrey, - Queens Bench.[17]
In 1841 the London Gazette advertised that all those with credit against Sir Hugh should 'Prove their debts' before a Commissioner at the office of the Court for Relief of Insolvent Debtors.[18]
In 1842 the London Times advised that The creditors of Sir Hugh Evelyn, Bart, now a prisoner for debt in the Queens Bench Prison, are informed that a dividend of three shillings and two pence in the pound may be received.[19]
In 1843 the London Gazette advertise that a further dividend of 3s 6d may be received on £2195 19s.[20]
In 1843 the London Gazette had a summary of Sir Hugh's residences which included the Kings Bench and Queens Bench Prisons.[21]
A further dividend of 1s 4d was advised in 1845 by the London Gazette.[22]

Residence
In the 1841 census Sir Hugh (age 72) and Dame Mary (38) were living at Westminster Road, Melina Place, in St George The Martyr, Surrey.[23]

Death & Legacy
Sir Hugh died aged 80 at Forest Hill, Sydenham on 28 August 1848[24] and was buried on 9 September 1848 in Wotton, Surrey.[25][26]

His estate passed probate on 28 June 1878 in England. His Beneficiary was his wife Dame Mary Evelyn but his estate was under £100.[24]

A notice in the 13 September 1848 "Manchester Courier And Lancashire General Advertiser" recorded Sir Hugh's passing:

At his residence, Forest Hill, Sydenham, Sir Hugh Evelyn, Bart., in his 80th year, the lineal descendant of John Evelyn, of Wotton, Esq., the well-known author of a valuable treatise on the cultivation of timber in the royal forests, and other works. Sir Hugh dying without male issue, the title becomes extinct.[27]

  • The Probate Index is dated 30 years after his death. No will has been found to date (Sept 2023).
  • There are several papers recorded in the National Archives of the UK pertaining to suits taken against Sir Hugh. These need on site visits to view.
