John Foster enlisted in the Continental Army in the Spring of 1776 in Captain John Morton's company of the 4th Virginia Regiment. He was wounded at the Battle of Trenton on 26 Dec 1776 and sent to Philadelphia to recover and then to Chester (PA), where he contracted smallpox. After he recovered from this in February 1777, he hired James McDearman as a substitute. He served four other tours of duty in the Virginia militia after returning to Prince Edward County, the last when he was drafted to serve at the siege of Yorktown in 1781. His pension application states that he was born in Amelia County in 1753.[1]

Affidavit of John Foster of Charlotte Co. Deponent, 79 years of age, appeared before Thomas Pettus, J. of P. 22 Jan., 1833. That he was a soldier in the Va. State line on the Contl. Establishment of the Rev. war. That he was well acquainted with Thomas Spencer of Charlotte--from 1765, or thereabouts, until the time of his death; that he was attached to the same Regt. and was in the battles of Brandywine, Germantown, and other battles in the North.
