Sources

  1. Ephraim Earl, a young man of about twenty years of age, was charged, on the Information of Maria Isabella Lawrence, a girl scarcely eighteen years of age, with deserting his illegitimate son. Mr. Jones appeared for the prosecution, and Mr. Pattison for the defence. The evidence of the girl showed that she had been acquainted with the defendant for twelve years, and that she was in the habit of walking into Stanwell to school from her father's - Charles Lawrence's - selection at Stewarts Creek with him. She averred that he had intercourse with her on the 15th January last, and again on the 23rd of that month - the day following her seventeenth birthday and preceding his, and that on the 27th of September she was delivered of a child - a boy. She produced the child in Court. Before Mr. Jones had concluded his examination, the Police Magistrate intimated that unless be was prepared to prove that the child was an eight months' baby, or in other words that it had been prematurely born, he could not succeed. Mr. Jones said he could not do that, and withdrew the information. The Morning Bulletin, ROCKHAMPTON. (1885, November 4). Morning Bulletin (Rockhampton, Qld. : 1878 - 1954), p. 4. 2. Maria Isabella Lawrence v. Ephraim Earl - child desertion. Mr. Brumm appeared for plaintiff, and Mr. Pattison for defendant, who pleaded not guilty.- Maria Isabella Lawrence deposed that the defendant was the father of a child to which she had given birth on the 27th September.- Dr. Wood gave medical evidence to the effect that the defendant might be the father of the child. The girl's father, mother, and sister were examined for the plaintiff.- Mr. Pattison said he did not think it was necessary to call any evidence. Plaintiff had not proved her case. The former case had been dismissed because she could not prove whether the child was a seven, eight, or nine months child, and it had not yet been proved. - The Bench wishing to hear any evidence that defendant might have to offer, Mr. Pattison called William Earl who deposed he was the father of defendant and lived at Stuart's Creek ; he remembered a conversation he had with plaintiff ; believed his son offered to pay 5s. a week for the child ; never heard his son offer to marry plaintiff. - Mr. Pattison contended it was impossible for defendant to be the father of the child. - The Bench found, the case fully proved, and ordered defendant to pay the sum of 7s. 6d. weekly for twelve months. No costs were allowed. The Morning Bulletin, ROCKHAMPTON. (1885, December 16). Morning Bulletin (Rockhampton, Qld. : 1878 - 1954), p. 4.
