Biography

John Layton, Sr., lived on a one-hundred acre tract of land which was part of a survey of one thousand acres entered by James Ingo Dozier and John E. King. In 1799, the land was rated as third class and the tax lists showed six horses in the possession of John Layton.

John Layton, SR and three of his sons, Bernard, John and Ignatius were successful in obtaining Spanish Land grants in the Louisianna Territory, where they immigrated by 1803. Joseph and Zachariah remained too long in KY to obtain Spanish land grants. Joseph did journey to Missouri to purchase land with the intention of settling on it, but he died on his return to KY to bring his family. Zachariah received land from his father. Some of Joseph Layton's descendants remained in KY as late as 1818, moving to MO, about the same time as the Brewers and the Elders.

Nothing is known of the social origins of John Layton, Sr. but it is safe to say that he instilled in his children a respect for the public trust. His sons were active in the formation of county government, the establishment of Perryville, and the foundation of Saint Mary's Seminary. His son John and his descendants Felix Layton, John C. Layton, Vernon Bruckerhoff and Leo Martin Dean have served as MO state representatives.

Life

John Layton, father of Joseph Layton, was born in England circa 1730. He was the son of Silas Layton. He married Jane Pearce. Eight children were born to this union. John died in Perry County, Missouri.

Various spellings of Pearce are found including; Pearse, Peirce, and Pierce. The name, Layton, is a “place name” and may have originated from a town or estate. In contrast, the name, Brewer, is a occupational name that originated from the work that person did.

2. Zachariah Layton, born January 13, 1765 in St. Mary's Co., Maryland; died October 23, 1839 in Perry Co., Missouri. He married Mary Ann Riney February 10, 1801 in Washington Co., Kentucky.

3. Susanna Layton, born March 12, 1766 in St. Mary's Co., Maryland; died Abt. 1766 in St. Mary's Co., Maryland.

4. Ignatius Layton, born August 24, 1768 in St. Mary's Co., Maryland; died 1774 in St. Mary's Co., Maryland.

5. Bernard Layton, born 1769 in St. Marys Co., Maryland; died November 06, 1848 in Perry Co., Missouri. He married Mary Yates September 24, 1799 in Washington Co., Kentucky.

Land Grants

LAYTON, JOHN, SEN’R., 640 Acres, on Cape St. Cosmos (Cinque Hommes). Now also mostly within the city limits of Perryville this survey also appears on the survey by McPherson, at the top of the surveys of Ignatius Layton and John Layton, Jr., sons of John, Sen'r. In April of 1810 John Layton, Sen'r. was granted 200 arpens of land, although he claimed 761 arpens, 40 perches, and was to have it surveyed in a square as much as possible. In September of that same year in the Land Records of Ste. Genevieve County (Bk 1, Entry 92, page 77);

“To all whom these presents shall come greeting, know ye that I John Layton of the Territory of Louisiana and District of Ste Genevieve for and in consideration of the love good will and affection which I have and do bear to my beloved son Zacheriah Layton of the same place and in consequence of his maintaining me and my wife Jane comfortably during the remainder of our lives by paying us one hundred and fifty bushels of corn per year and one third part of what small grain and flax he raises on the tillable land and affording us other assistance when necessary as long as we or he doth live, do give and grant unto the aforesaid Zacheriah Layton his heirs or assigns after the death of me and my wife Jane, a certain tract or parcel of land containing two hundred arpens confirmed lately by the United States Commissioners for adjusting titles and claims to lands in the Territory of Louisana on which the said John Layton now resides in the aforesaid tract or parcel of land with all the appurtenances thereunto belonging from and after both of our deaths. In testimony whereof I have here unto set my hand and seal this seventh day of Sept. in the year of our Lord one thousand eight hundred and ten.” s/ John Layton (Seal)

"The first reference to John Layton was the record of the births of several of his children in the registers of Saint Andrew's Episcopal Church near Leonardtown, Maryland, the earliest 1762". John signed his name Leaton.
