Dr Meurer obtained a patent in 1966 for a compartmental dispensing container for nose and throat preparations. [5]

Dr B L Meurer of Adair, Iowa was a chiropractor. He founded the Adair Benevolent Society in 1941. Its headquarters were moved to Orange City, Florida, in 1963. The business was owned (in 1992) by Meurer's daughter-in-law who lived in Georgia. Meurer's grand-daughter-in-law managed the business. The Adair Benevolent Society functioned as a clearinghouse for disbursing assessments from members to beneficiaries of deceased members. The State of Iowa sued charging that the Adair Benevolent Society was not a licensed insurance agency under Iowa law.

At the administrative hearing, the Society alleged that chapter 512A was unconstitutional because it (1) was an ex post facto law, and (2) impaired the right to contract. On these bases the Society asked for alternative forms of relief: (1) allow the Society to continue in business as it had in the past, or (2) allow it to incorporate and become a licensed benevolent association.

The case reached the Iowa Supreme Court because of these constitutional issues.

The court ruled against the Society, showing that it had not incorporated under Iowa law and that the provisions were not ex post facto. Moreover the Society had had 21 years to bring itself into compliance and had not done so. [6]
