James was born in 1823 in either Georgia or North Carolina, His parents were from North Carolina. His father was James Bryant Oliver Sr, and his mother was Catherine Hathcock (Probably related to the Hathcox family in Troup County). He was married to Millie Greer in Troup County, Georgia in 1844. According to online sources, he moved west into Alabama and then to Louisiana. One of his sons was born in Louisiana:
James then moved to Upshur County, Texas probably along with his father-in-law. He was living there by 1857 when he appears in the tax rolls; Jms B. Oliver 160 acres value 250, original grantee Sophia Sanders part of an original head right of 320 acres, 3 Negros value 2000, 1 horse/mule value 80:
When the war started he served in the Confederate Army. He was enlisted in Company I of the 14th Texas Infantry:
