WILL OF PETER PATTERSON OF WASHINGTON TWP., FAYETTE CO., PA
Note: Peter’s will can be found in Original Will Book 1, pg. 214. The original will itself is in amazingly good condition and is still legible, but the microfilm of this Original Will Book was not exposed in a way conducive to legible copies. Fortunately, many years ago, the Fayette Co. Office of Wills made a handwritten transcription of their oldest wills, and a transcription of Peter Patterson’s will can be found in Transcription Will Book 1, p. 710. The microfilm of the transcibed will does, thankfully, yield a legible copy. We have a copy of both the original and the transcribed will. As far as we can tell, the transcription is a pretty faithful copy of the original. Here is OUR transcription (from the original whenever possible).
This the sixth day of October in the year of our Lord eighteen hundred and eighteen I Peter Patterson of Washington Township County of Fayette & Commonwealth of Pennsylvania being weak in body but of perfect mind and memory, therefore calling to mind the mortallity of my body and knowing that it is appointed that all men to die, do make and ordain this my last Will and Testament that is to say first of all I order that my body be buried in a Christian like and decent manner at the discretion of my Executors, and as touching such worldly estate wherewith it hath pleased Providence to bless me with in this life I give devise and dispose of in the following manner & in form [Impremise?] it is my will and I do order that in the first place all my just debts & funeral charges be paid and sattisfied Item and bequeath unto my beloved wife Mary the one half of all and singular my household furniture and kitchen stuff viz. as to bedding Cupboard Dresser pots & every other matter as to household furniture and kitchen apparatus the full diffdend of one-half also one horse Saddel and bridel one [Coru?] togeather with the one-third of all dues and money to me belonging at my death as I have heretofore bound by article my son James and grand Son Peter to completely maintain my said widow during her life. Yet it is to be understood that there is more one feather bed & bedding that belongs to my said wife and to be considred as hers exclusive of her diffidend as here mentioned. Item I have before this date given unto my Son James his share in full of my Estate—Except my wearing apparel which I will unto my said Son James Item It is my will & I do order that my Son Thomas shall have the one half of the remainder of my Estate after all Legacies and dues in this will are paid & sattisfyed being an equal diffidend with Andrew Patterson as here after mentioned in this will. Item I also will unto my son John one hundred Dollars as soon as recovred by my Executors after my decease. Item Whereas I have an obligation on my Grand Son Patterson Espy calling for four hundred Dollars principel with the interest thereon which obligation with the Contents its my will that it be disposed of in the following manner viz. One hundred and fifty Dollars thereof to my Daughter Mary Espys daughter Nancy Bennet and one hundred and Twenty Dollars thereof unto my said Daughters Son Josiah and fifty dollars of the same unto my said Daughters Son James and the remainder of said Obligation to be equally divided between my said Daughter Mary Espy and her Son Patterson which it is my will that my Executors deliver the same into the hands of Anthony Bennet and Josiah Espy son and son in law to my Daughter Mary Espy and that they the said Anthony and Josiah is hereby fully empowered to ask for and receive the same and place the amount agreeable to the direction of this will as this part is not to come before my Executors as my widow is to have no share of said obligation as here stated due from Patterson Espy. Item I also will unto Andrew Patterson Son of my Son John the one half of the money to me belonging after the foregoing dues are paid as here before willed. Item It is my will and I do order that my Executors put all my movable estate not herebefore willed and bequeathed to publick sale as soon as possible and Conveniant after my death on a Reasonable credit and where the money arising therefrom is Recovered place it to the legatees as here willed but my Executors shall not be Compelled to go after the Legatees but they or their Legal Representatives shall come forward and demand the same. Item I likewise constitute make and ordain my only and Sole Executors of this my last will and Testament—my trusty and well beloved neighbour William Patterson (son in law to Martha Crawford) and Samuel Cooper and my Son James Patterson and I do hereby utterly disallow Revoke and disannul all and every other former wills Legacies and Executors by me any ways before this time named or willed by me rattitying this and no other to be my last will and Testament. In witness whereof I have hereunto set my hand and seal the day and year first here cited.

Before me the subscriber Register for the Probate of wills and Granting Letters of Administration in and for said County personally came Anna Whiting and Peter Patterson two of the signing witnesses to the foregoing last will & Testament and on their solemn oaths did declare tht they saw the Testator when of right mind sign the same as and for his last will and Testament that they signed the same as witnesses in his presence that no undue influence had been used or later will made by him to their knowledge or belief—In Testimony whereof I have set my hand and seal the same day.
