Will of Dew Rogers

In the name of God Amen. I Dew Rogers being weak of body, but of sound mind and disposing memory do make this my last will and testament in manner and form following:

1st Item. I give devise and bequeath unto my son Zany Rogers two hundred acres of land more or less where he now lives and two cows and calves that he has now in possession.

2 Item. I give and bequeath unto my son Jesse Rogers two hundred dollars to be paid in money or good notes.

3 Item. I give and bequeath unto my three sons Henry, Bigham, and Barfield Rogers six hundred and twenty-five acres of land situated on the East side of Bear Swamp, where they now live to be equally divided and also one cow and calf each.

4 Item I give and bequeath unto my son John Dew Rogers, three hundred acres of land situated in North Carolina, Roberson County and two cows and calves now in his possession.

5 Item. I give and bequeath unto my son Ebeneser Rogers two hundred acres of land more or less known as the Comfort Allen Tract, also one cow and calf and the privilege of timber on the other land.

6 Item. I give and bequeath to my dearly beloved wife Mary Rogers the plantation where I now live and three Negroes. (To wit) Clary and Jude two women and Jack a Negro man; also all of my household and kitchen furniture; also all of my stock of horses, cattle, sheep, and hogs; except each single son and daughter to have one cow and calf each during her life time and the tract of land to be equally divided between my two sons Robert and Hinard Rogers, and the three Negroes Clary, Jude, and Jack together with all the stock, household, and kitchen furniture to be sold at the death of my wife and equally divided between all of my children, share and share alike, except Judes increase and if any of her children is to go to my five daughters, Beady Looper, Mary Ann Rogers, Susan Rogers, Sealy Rogers, Hannah Rogers.

7 Item. I give and bequeath unto my daughter Beady Looper three hundred acres of land situated on the East side of H. Caddys mill pond, it being more or less or to my Executors to hold to them my Executors and their Executors, and administrators and assigns.

Upon this Special Trust and Confidence never the less that is to say that they my Trustees or the Survivor of them or their Executors or Administrators of such survivor permit my daughter Beady Looper to occupy and posses the tract of land above mentioned and to receive and enjoy the rents, issues and profits of the said land during the term of her natural life and to be in no wise subject to the debts of her husband Alexander Looper, if there be no child of the said Beady that may have arrived at the age of twenty-one years to stand seised of the premises aforesaid to hold the same for the use and benefit for the lawful children of the said Beady until such time as one of the children of the said Beady may have arrived at the age of twenty-one years and then to see the property justly divided between the lawful children of the said Beady, but not until her death.

8 Item. I give and bequeath unto my daughter Hannah Rogers, one Negro girl named Betsy upon trust that my Executors shall see the Negro girl with her increases shall be hired out and my said daughter to receive the labor and her future increases during the natural life of the said Hannah and in no wise to be subject to the debts of her husband or under his control during her life time or until one of her children shall arrive of the age of twenty-one years of age and then that child to stand Seised of the property for the use and benefit of the said Hannah until her death.

9th Item. I give and bequeath upon Trust to my three daughters Mary Ann, Susan, and Sealy Rogers two Negro Girls named Beck and Nance that my Executors shall see that the two Negro girls shall be hired out for the use and benefit of the said three daughters with their future increase also to have one cow and calf during their natural life and in no wise ever to be subject to their husbands debts or under their control until one of their children shall arrive of the age of twenty-one years to stand Seised of the said Negro girls and their increase and to see that Justice shall be done to my said daughters during their life time also they are to have one cow and calf apiece.

10th Item. Also my Trust that the Trustees shall, as soon after my death as conveniently may be, sell and dispose all the property that I may be in possession of at my death as has not been above disposed of, sell and dispose of, on a credit or for money as to them shall seem most advisable, and after paying all of my just debts the proceeds to be equally divided between my lawful heirs. Share and Share alike. Subject however to the same restriction as the property herein before bequeathed to the use and benefit of my daughters respectively is restrained and limited, and my Trustees are hereby empowered to such investment of the money arising from the said sale as to them shall seem most proper to carry out the Trust aforesaid.

11th Item. Also upon Trust that the Trustees shall if either of my children herein before mentioned die without leaving issue alive, at the time of her death, hold the share placed in Trust for her benefit and shall go to the benefit of her sisters, subject to like trust as herein before provided.

12th Item. I give and bequeath unto my daughter Effy Callwell three hundred dollars in good notes or money.

And lastly I do hereby nominate constitute and appoint Ebeneser Rogers my brother and Major Daniel Carmichael my Trustees and Executors of my last Will and Testament hereby revoking and making void all former Wills and Testaments at any time heretofore by me made and I do declare this to be my last Will and Testament.

In witness I hereunto set my hand and seal this 15th day of November A. D. 1851.

Signed Sealed published and declared by the above named Dew Rogers as and for his last will and testament in the presence of us who at his request and in his presence have subscribed our names as witness thereunto.
