Robert is noted as being the eldest son and heir to George Rutherfurd and his wife Janet Rutherfurd.^[2]

He appears, designed as "of Chatto" when he received a charter from Archibald, fifth Earl of Douglas, confirming to him as his dear esquire, the gift of his late father, Archibald, Earl of Douglas, to George of Rutherfurd, Robert's father, of the lands of Nether Chatto and others on 21 November 1429, which was confirmed by the Crown 25 March 1439.

In 1464 (13 July 1464) he had a grant of lairs in the Abbey of Jedburgh from the then Abbot, to him and Margaret his wife.

In 1467, he had a charter, under the Great Seal, 18 January 1466-67 (modern era 1467), confirming a charter by Sir Simon of Glendinwine of that Ilk, to him and Margaret his wife of certain lands in the west part of the town of Scraisburgh, commonly called Hunthill, dated 12 December 1465, in which he was seised the same day.

In 1484, he, with his son George, had a tack from the Crown of the lands of Midsteid of Windedurris in Ettrick for three years from 1484.

He died c. 1493 as his son is served heir to him on 2 May 1495.

He married Margaret, daughter of Sir Simon Glendinwyn of that Ilk. They had children:

• George Rutherfurd, his son and heir.
• Robert Rutherfurd, of Chatto, in which estate he succeeded his father, his brother getting Scraisburgh, Capehope, etc. He married a lady named Janet, and was ancestor of the family of Rutherfurd of Chatto.
• Richard Rutherfurd, of Glennysland, son of Robert Rutherfurd of Chatto, had a charter of 2 merks land of the same under the Great Seal 25 July 1468, on the resignation of Christian Glen, heiress thereof, and wife of David Stewart. He was killed, along with Sir William Colville of Ochiltree by George Haliburton and others in 1508 or 1509, and was ancestor of the Glennysland family.
• Margaret Rutherfurd, married to Hugh Wallace of Craigie. She had a charter of the lands of Tlmriston, etc., in Renfrewshire, 22 September 1505.
• Helen Rutherfurd, married to Philip Nisbet of that Ilk, and had a charter of Birghamshiels in Berwickshire 20 January 1506-7 (modern era 1507).
