Will of Barnabas Torrence, 25 Feb 1840, Iredell Co., NC[1]
In the name of God Amen, I Barnabas Torrence of the county Iredell in the state of North Carolina, having the uncertainty of life in view, but at the same time being of sound and perfect mind and memory (blessed be God) do this 25th day of February in the year of our Lord 1840, make and publish this my last will and testament in manner following, (that is to say)
First I give and bequeath unto my beloved wife Elinor her choice of a bed bedsted an furniture, one commode one teable, looking glass, all my cubard furniture, my horse her saddle and bridal one cow and calf her choice, also her choice of kitchen furniture
2d- To my son Alexander I give and bequeath a note of hand I have on him between seventy and eighty dollars, all my waring apparel is to be divided between him & Edmon Caldwell.
3d - My lands I allow to be sold and the deed of trust my sister Margaret Torrence has on it to be paid out of the land, also all my property of every description that I have not bequeathed to be sold and out of the sale of the said property and land my lawful debts is to be paid, and the remindure to be divided as follows (that is)
4th - I will and bequeath to my daughter Mary the wife of Pinkney Cathey> twenty dollars.
5th - I give and bequeath unto my daughter Cathrin the wife of Houston Johnston twenty dollars.
6th - I give and bequeath the ballance of my estate unto my daughter Ann the wife of Edmon Caldwell.
Lastly I hereby make and ordain my worthy friend Alexander Torrence Executor of this my last will and testament. In witness whereof I the said Barnabas Torrence have set my hand and seal the day and year first written.
The petition of Ann McGahey respectfully shows unto the Court
I. That she is the widow of Milton McGahey late of the County of Mecklenburg who died in April 1871 intestate and seized {in fee} of following described lands viz -- A tract of one hundred acres of land situate in Mecklenburg County adjoining lands of Sam'l. Black, Mrs R. C. Potts dower land Chas B. Wilson and others situate on the public road from Charlotte to Beatties Ford and about 16 miles north of Charlott upon which said land said deceased lived and died.
II. That deceased left surviving him the following heirs at law -- Mary wife of Ezekiel Alexander of Mecklenburg County Laura wife of Milton Goodrum of Mecklenburg Co William McGahey -- who resides in Perry Co Alabama and James and Margaret infant children of John McGahey decd. who also live in Perry County State of Alabama and are without any guardian in this State and James infant son of Stanhope Brown who lives in Mecklenburg Co with his said farther and is also without guardian
Wherefore she prays that she may be adjudged entitled to dower in the said tract of land and that all necessary writs and order may be made by the court so that the same be laid off and assigned to petitioner and that guardian ad Litems be appointed for infant defendants and an order of publication for non resident heirs & as is duly bound your petitioner will ever pray.
