Inf. Charles Roberts, Co. G 55th Mass. Vol. Inf. (colored) of Marion Branch was seen but could give no information bearing on issues. Adjutant Stuart McGowan was engaged in matters he could not well leave long enough to submit to a formal interview by interrogatories, so asked me to make a copy of such record and file matter as was desired and he then signed my certificate and was sworn to same. This explains the informal preparation of his deposition and omission of preliminary oath. The testimony herewith rather conclusively shows, taken in connection with previous testimony, that claimant was not the James H. Jackson, Sgt. Co. D 54th and B 55th Mass. Col. Vol. Inf. It is most likely that he was in some company of the 54th and as the two regiments were brigaded

Sir:

I have the honor to return with report claim Inv.Ctf.No.922,015, James H. Jackson, Sergeant Company D 54th and B 55th Massachusetts Volunteer Infantry (Colored), address, 562 Shawmut Avenue, Boston, Massachusetts, sent here, notice waived, in the course of further examination as to identity of claimant and if not identical with James H. Jackson, Sgt. Co. D 54th and B 55th Mass. Vol. Inf. (Colored) to ascertain what service, if any, claimant was in.

Beside taking the testimony submitted, I saw and interviewed John H. Martin, Co. A 55th Mass. Vol. Inf., who recalled claimant as a member of the Home, Marion Branch, but could not recall him as in the 55th Mass. Vol.
