He left his estate to be divided into 5 parts and bequeathed equally to his son William Wyborn, his daughter Mary the wife of Daniel Hinds, his daughter Anne Goldsmith the widow of Ebenezer Goldsmith, his daughter Elizabeth the wife of John Leake Jarman and his son Thomas Wyborn. Sums lent at interest to his sons and sons-in-law were to be taken into account in the reckoning. Probate of his will was granted 18 February 1846 in the Archdeaconry Court of Canterbury.
