Last Will and Testament:
On December 14, 1631, Humfrey Wharton, Esq. of Gillingwood, County of Yorke, executed his Last Will and Testament leaving his Estate as follows: first, that his executor pay all debts out of his personal estate and the profits of the testator's real property, namely those in (illegible) in the Rectory of Ravenstonedale[1] and Manor of Dufton in Westmorland in the names of Fitzhugh Lyntton, Esq. of (illegible) in the County of Durham and of testator's second son Anthony Wharton; second, that the testator does appoint the Anthony Wharton, Aramid Sharprett (?), and Michaell Wallen (?) to release and convey the said lands to Thomas Wharton in fee tail; third, after payment of his debts, the remainder of his personal estate to his son Thomas Wharton; fourth to his son George Wharton, an annuity of 20L for life coming out of his lands in Eppleby and Carleton in the County of York; fifth, after payment of his debts, to Thomas Wharton the lands in Eppleby and Carleton in the County of York in fee tail, subject to payment of the annuity provided to his son George Wharton; sixth, he nominated his son Thomas Wharton the executor of his estate. The Will was proved on January 8, 1635.[2] [3][4]
