Biography

Henry Richard was born in 1875, with his twin Owen. He was the son of William Cadwallader and Elizabeth Flood. [1] He married Mary Bayliss in 1902 [2] As she had been previously married, but not yet divorced, the marriage was nullified in 1903

A MUCH-MARRIED WOMAN. Henry Richard Cadwallader, a farmer, residing near Carterton, sought a decree of nullity of his marriage with Mary Anne Whitburn on the ground that when he married the woman she had another husband living. James Henry Whitburn, a youthful looking Benedict, gave evidence of having married the respondent, then Mary Anne Bayliss, at her father’s house, St. David’s street, Dunedin, on March 2nd, 1898. About three and a-half years afterwards, she left'-him in Dunedin. He had never been divorced from her. She . afterwards married Cadwallader. After some scrutiny he identified a photograph of the woman, Mr Justice Cooper remarking that the witness ought to know his own wife. The petitioner stated that he was married to the woman under the name of Mary Bayliss, at Carterton, on August 8th. 1902. He was not aware at the time that she had been previously married, but he only lived with her one week, as he ascertained she had a husband living. On being taxed with the fact, she could not give any explanation. . _ . . Petitioner’s counsel (Mr Young) informed the Court that the respondent had "apologised.” His Honor granted a decree of nullity.[3]

He passed away in 1904 age 29 [4] , drowning alongside his nephew Owen Udy, daughter of his sister Mary Ann

The body of Henry Richard Cadwallader, who was drowned in the Ruamahanga. river on April 7th, was found on Wednesday, a mile and a half below where he attempted to cross. No inquest will be held, the inquiry into the circumstances when the body of Udy (who was drowned at the same time) was recovered being considered sufficient. [5]
